November 18, 2008
After consideration Qualification Commissions' of Judges recommendations and speaking with the candidates to the positions of judges of local administrative courts the High Council of Justice took a decision to forward submissions to the President of Ukraine regarding appointment of 7 candidates. 8 candidates were refused.
The High Council of Justice found impossible the execution of the Petchersk district court, Kyiv, decision from October 28, 2008 on ensuring the claim of Serhiy H. SHTOGUN to Volodymyr M. KOLESNYCHENKO in the way of prohibition Mr. KOLESNYCHENKO to participate in the High Council of Justice sessions with the powers of the HCJ's member and to execute these powers before making a decision in the mentioned civil case.
The Council came to such conclusion after consideration of the claim's full text, discussion Mr. Kolesnichenko's claim "on illegal blocking of HCJ's member activities" and analysis of all case issues.
As it is mentioned in the HCJ's decision, the resolution of the Petchersk district court, Kyiv, from October 28, 2008 on ensuring the claim of Serhiy H. SHTOGUN doesn't obligate to take any actions as well as to withhold from taking any actions. There is no explanation of how the Council should execute this resolution, so the constitutional body has no possibility of its fulfilling. At the same time, the third item of operative part says that the resolution should be immediately fulfilled.
Concerning that under point 19 item 4 of Regulations On the Ministry of Justice of Ukraine, adopted by the Cabinet's of Ministers of Ukraine Decree from November 14, 2006 № 1577, the Ministry of Justice of Ukraine is responsible for timely, full and unprejudiced compulsory execution of courts' decisions, the High Council of Justice of Ukraine decided to apply to the Ministry of Justice of Ukraine for explanation of how the Council should fulfill the mentioned resolution. The copy of this decision will also be forwarded to the Petchersk district court, Kyiv.

November 11, 2008
At the session of the High Council of Justice the decision was taken to forward submissions to the President of Ukraine regarding appointment of 31 candidates to the positions of judges, namely: 16 candidates ? judges of local administrative courts, 13 ? judges of local general COURTS, one ? local \economic court and one to court of appeal. Three candidates were refused, namely: one candidate to the position of the judges of appeal court and two candidates to the positions of judges of district administrative courts.
The Council took a decision to forward submissions regarding dismissal of two judges from office on general reasons that is on retirement and by their own decision.
The High Council of Justice of Ukraine found no reasons for the dismissal from office because of oath violation of 9 judges of local general courts and one judge of local economic court as well as adopted the results of verification of information given in the recommendations of Qualification Commissions of General Courts, claims of National Deputy of Ukraine, officials, advocates and claims of citizens concerning these judges.

On its plenary session the High Council of Justice of Ukraine took a decision to forward to the President of Ukraine the submissions regarding appointment of 68 candidates to the possessions of judges, namely: 46 candidates to the position of judges of local administrative courts, 17 candidates to the positions of judges of local general courts, 3 candidates to the positions of judges of local economic courts and 2 candidates to the positions of judges of appeal economic courts. Five candidates to the positions of judges of district administrative courts, 2 candidates to the positions of judges of local general courts and one candidate to the position of the judge of local economic court the Council refused in forwarding their submissions.
The Council adopted the decision to forward submissions regarding dismissal of 5 judges from office on general reasons that is because of their retirement and on their own decision.
The High Council of Justice of Ukraine found no reasons for the dismissal of 7 judges of local economic courts and 17 judges of local general courts from office because of oath violation and adopted the results of HCJ's members examination of information given in the requests of the National Deputies of Ukraine, officials and citizens' claims concerning these judges.

The High Council of Justice on its plenary session took a decision to forward the submissions to the President of Ukraine regarding appointment of 34 candidates to the positions of judges, namely: 2 candidates to the positions of judges appeal economic courts, 11 candidates to the positions of judges of region administrative court, 16 candidates to the positions of judges of local general courts and 5 candidates to the positions of judges of local economic courts.
The Council adopted the decision to forward to the President of Ukraine and the Verkhovna Rada of Ukraine submissions regarding dismissal of 9 judges from office on general reasons.
The HCJ considered the letters of the Verkhovna Rada of Ukraine Committee on Justice № 04-30/18-167 from 19 September 2008, № 04-30/18-178 from 29 September 2008, as well as the letters of Deputy Head of the Secretariat of the President of Ukraine ? President of Ukraine Commissioner for controlling the activities of the Security Service of Ukraine Ihor G. Pukshyn № 43-02/3209 from 25 September 2008, № 43-02/3255 from 29 September 2008, by which the submissions regarding dismissal of 6 judges of local general courts from office on general reasons were returned to the Council. The High Council of Justice of Ukraine took a decision to forward for second time to the President of Ukraine and the Verkhovna Rada of Ukraine the submissions regarding the mentioned judges, which should be dismissed.
The Council found no reasons for dismissal from office because of oath violation of a judge of appeal court, a judge of appeal economic court, five judges of local economic courts and six judges of local general courts. The Council adopted the results of the HCJ members' examinations of the information given in the requests of the national deputies of Ukraine, officials and citizens' claims regarding these judges.
The High Council of Justice of Ukraine satisfied the claim of the judge of Ichyanskyy district court, Chernigiv region, on the decision of Qualification Commission of Judges of General Courts, Kyiv appeal region, concerning his calling to disciplinary liability, having abolished the decision of the Commission and closed disciplinary proceedings in the case.

The High Council of Justice of Ukraine took a decision to forward to the President of Ukraine submissions regarding appointment of 31 candidates to the positions of judges, namely: 21 candidates to the positions of judges of local general courts, 6 candidates to the positions of judges of local administrative courts, 3 candidates to the positions of judges of appeal courts and one candidate to the position of the judge of local economic court. One candidate to the position of the judge of appeal administrative court was refused.
There was adopted the decision regarding dismissal of 4 judges from office on general reasons.
The High Council of Justice of Ukraine satisfied the claims of 4 judges on the decision of Qualification Commissions. Namely, there were abolished the decisions of Qualification Commissions of Zhytomyr, Dnipropetrovsk, Kharkhiv appeal districts and High Qualification Commission of Judges of Ukraine.
The High Council of Justice considered the HCJ's members proposals concerning 2 judges and recommendation of Qualification Commission of Judges of Military Courts of Ukraine concerning one judge regarding their dismissal from office because of oath violation. After collective studying of the issue the Council decided to decline the HCJ's members proposals and Qualification Commission's recomendation.

September 10, 2008
The Hugh Council of Justice of Ukraine on its session took a decision to forward to the President of Ukraine appointment of 49 candidates to the positions of judges, namely: 28 candidates to the positions of judges of administrative courts, 19 candidates to positions of judges of local general courts, one candidate – appeal economic court and one – local economic court.
The Council took a decision to forward submissions regarding dismissal of 15 judges from office on general grounds.
According to the Council's decision the submission regarding dismissal of Ganna LOBODA from her position of the judge of Kivertsivskyy district court, Volyn region, will be forwarded to the President of Ukraine.
According to the claims of officials, National Deputies of Ukraine and other citizens the High council of Justice considered and satisfied the materials of the HCJ's members verification of information concerning 14 judges, having found no signs of oath violation in their actions.
According to the submissions of the Heads of Kyiv and Dnepropetrovsk appeal economic Courts, appeal court of Zaporizhzhya region and according to the Rules about awards of the High Council of Justice of Ukraine the Council took a decision to honor the judges with the Honorary Decoration of the High Council of Justice for considerable contribution in strengthening the law, high qualification and professional qualities.

July 8, 2008
The regular session of the High Council of Justice of Ukraine took place. Consideration of its agenda started on July 1, 2008, when HCJ's members, having discussed the third part of issues, agreed to continue in a week and accept the appropriate decisions by voting.
After consideration of the materials of Qualification Commissions the Council took a decision to forward submissions to the President of Ukraine regarding appointment of one candidate to the position of the judge of the appeal court, one candidate to position of the judge of appeal administrative court, 28 candidates to the positions of judges of district administrative courts, 4 candidates to the positions of judges of local economic courts, 9 candidates to the positions of judges of local general courts. 2 candidates to the positions of judges of district administrative courts the Council refused in forwarding submissions regarding their appointment.
The Council took a decision to forward submissions to the President of Ukraine and the Verkhovna Rada of Ukraine regarding dismissal of 18 judges from office on general grounds.
Having heard the report of the Chairman of the High Council of Justice of Ukrain, Lidiya IZOVITOVA, concerning the protocol decision of the Verkhovna Rada of Ukraine from June 5, 2008 with the demand to the High Council of Justice to forward to the Parliament's consideration the submission regarding dismissal of Serhiy DEMCHYK from the position of the judge of the High Economic Court of Ukraine, the Council agreed with the conclusions and proposals of Lidiya IZOVITOVA and took them to consideration. The HCJ's Chairman forwarded to the Chairman of the Verkhovna Rada of Ukraine the letter with the information that on July 8, 2008 there were no materials in the High Council of Justice concerning dismissal S. DEMCHENKO from his position of the judge. The Council may consider this issue after receiving the proposals of the High Qualification Commission of Judges of Ukraine, which started on January 21, 2008 the procedure of dismissal S. DEMCHENKO from office because of handing in his resignation.
Having considered the information given in the request of the national deputies of Ukraine, officials' and citizens' claims, the HCJ's members adopted its results, having found no reasons for calling to disciplinary liability of 3 judges of the Supreme Court of Ukraine, 5 judges of the High Economic Court of Ukraine, 4 judges of the High Administrative Court of Ukraine. The Council also found no reasons for the dismissal of 4 judges of appeal economic courts, 2 judges of local economic courts and 2 judges of local general courts from office because of oath violation

June 3, 2008
The High Council of Justice of Ukraine considered on its session the materials of Qualification Commissions of Judges concerning candidates' appointment to the positions of judges. After the interview and according to the results of secret voting on each candidature the HCJ's members took the decision to forward submissions to the President of Ukraine regarding appointment of 18 candidates to the positions of judges of local general courts and one candidate to the position of the judge of district administrative court, but 14 candidates were refused.
The Council also took a decision to forward to the President of Ukraine and the Verkhovna Rada of Ukraine submissions regarding dismissal of 3 judges from office on general reasons.
Having heard the report of the Deputy Chairman Mykola SHELEST and HCJ's member Volodymyr KOLESNYCHENKO, and also explanation of judges, the Council has backed up the guidelines of Qualifying Commissions of Judges of General Courts of Dnepropetrovsk and Sevastopol appeal districts about dismissal of Yuriy USATENKO from office of the judge of Malovyskivskyy district court, Kirovograd region, Tetyany PIMENOVA from the position of the judge of Alushtinskyy city court, Autonomous Republic of Crimea. Submissions regarding dismissal of the judge PIMENOVA T. will be directed for acceptance of the final solution to the Verkhovna Rada of Ukraine, and information on a violation of oath by the judge USATENKO Yu. will be directed on consideration to the Committee on justice of the Verkhovna Rada of Ukraine, as for the powers of this judge terminated and he waits on his open-ended election as a judge in the Verkhovna Rada of Ukraine.
Besides, the Council also declined the recommendations of Qualification Commission of Judges of general courts, Zhytomyr appeal region on adoption of submission regarding dismissal from office of the judge of Starosynivskyy district court, Khmelnitsk region, because of oath violation.
After consideration of the examination's materials of the information given in the citizen of Ukraine claim, the members of the High Council of Justice adopted its results, having found no reasons for calling to disciplinary liability of the judge of the Supreme Court of Ukraine and 5 judges of the High Administrative court of Ukraine.

May 27, 2008
The regular session of the High Council of Justice of Ukraine took place. Having considered the issues of judges' appointment, the Council took the decision to forward submissions to the President of Ukraine regarding appointment of 16 candidates to the position of judges of local administrative courts, 5 candidates to the position of judges of local economic courts, 26 candidates to the position of judges of local general courts and 1 candidate to the position of judge of appeal administrative court.
By the Council's decision 4 candidates to the position of judges of local general courts and 1 candidate to the position of judge of local administrative court were refused in forwarding submissions regarding their appointment.
The High Council of Judges also took a decision on forwarding submissions to the President of Ukraine and the Verkhovna Rada of Ukraine regarding dismissal from office of 11 judges on general reasons.
The Council adopted the results of the HCJ members' examinations of the information given in the request of the national deputies of Ukraine, officials and citizens' claims regarding absence of reasons for the dismissal of 31 judges from office because of oath violation. Namely, 8 judges of general appeal courts, 3 judges of economic courts of appeal, 5 judges of local economic courts, 14 judges of local general courts and one judge of local administrative court.
Besides, the High Council of Justice declined the recommendations of the HCJ's members on adoption of the submissions for the dismissal of the judge of Kyiv interregional economic court of appeal and the judge of Kyiv economic court from office because of oath violation.

Under the chair of the Chairman of the High Council of Justice of Ukraine Lidiya IZOVITOVA the session of the Council took place, where the decision was taken to forward submissions to the President of Ukraine regarding appointment of 33 candidates to the positions of judges. 4 candidates were refused.
The Council also took decision to forward submissions to the President of Ukraine and the Verkhovna Rada of Ukraine regarding dismissal 5 judges from office on general grounds.
During the session the verification materials of claims to the Council regarding dismissal of 19 judges from office because of oath violation were considered. After their analysis, the HCJ's members decided, that there were no reasons for their dismissal.
The Council also took a decision to satisfy the claims of 4 judges concerning their calling to disciplinary proceedings, having declined the decisions of Qualification Commissions of Dnepropetrovsk, Zaporizhzhya, Lviv and Sevastopol appeal districts.
The Council declined the claim of Serhiy POPOVYCH, judge of Oleksandriysk city district court, Kirovograd region, on the decision of the Qualification Commission of judges of general courts, Dnipropetrovsk appeal district.
The High Council of Justice took a decision to forward submission to the Verkhovna Rada of Ukraine regarding dismissal of Volodymyr SKORYK, judge of the Solominskiy district court, Kyiv, and Yuriy KUKHALEYSHVILI, Shevchenkivskyy district court, Kyiv, from the positions of judges because of oath violation.
While considering this question, the discussion was raised concerning the issues of necessary qualification level of candidates to the position of judges. A lot of educational institutions prepare jurists, but important, basic for legal profession, knowledge in civil, criminal law etc, differs depending on the institution. In some institutions the quantity of hours for preparation is solid, but in the others ? reduced in twice or in three times. This situation raised the issues whether the reduced preparation program of jurist is enough for obtaining the judge's position. For consideration of this issue the representative of the Ministry of education and science of Ukraine was invited for the HCJ's session. As Yuriy DUDNYK, the Ministry's representative, explained, the problem occurred because of the absence of the state, officially adopted, educational standards, which include professional-educational program of preparation in the specialty of certain educational-qualification level and educational-qualification characteristic. "I wish there were no problems with adoption of these Standards. Educational institutions while being licensed, namely in the "Jurisprudence", develop so-called Temporary Standards – said Yuriy DUDNYK. – Because of absence of Branch Standard, which is part of the State Educational Standard, every educational institution persuades and Scientific - methodical commission on directions of preparation, and Institute of innovation technologies and contents of education, and Department of a higher education of the Ministry of education and science of Ukraine, which is sacrament to the coordination of the educational schedules, demonstrates, that the level of teaching is sufficient for preparation of the specialist". In opinion of the HCJ's members, this circumstance superimposes the large responsibility on the Council's members concerning objective estimation of a sufficient qualifying level of preparation of the candidate to the position of a judge.

The High Council of Justice of Ukraine celebrated its 10 years anniversary. The Ceremonial Meeting of the Secretariat's body took place in the morning in the Council's Session Hall. The Chairman of the High Council of Justice Lidiya IZOVITOVA congratulated with the anniversary, thanked officially the body for their conscientious work, marked the work of the leading divisions, as well as honored the best employees according to the Council's decision with Honorary Decoration of the High Council of Justice of Ukraine and Honorary Diploma of the High Council of Justice of Ukraine for exemplary execution of their duties, initiative in organization and provision of the Council's activities. Also gratitude was expressed for the group of Secretariat's employees.
At the end of the day in the House of State Ceremonial Actions, situated on 22, Grushevskogo str., the Ceremonial Meeting and Formal Reception took place, where participated members of the High Council of Justice, National Deputies of Ukraine, judges, lawyers, prosecutors, officials form different ministries and state bodies, representatives of judicial science end education, public legal organizations and Mass-Media.
The Ceremonial Meeting was opened by the speech of the Chairman of the High Council of Justice Lidiya IZOVITOVA. She congratulated the Council's members and the guests with the anniversary and reminded the present the history of creation and development of the High Council of Justice as collective independent constitutional state institution, told, how the work on formation of the highly professional corps of judges was hold and presented some statistic information regarding the Council's ten years activities. Lidiya IZOVITOVA also stressed in her speech on the issues, which prevent the Council from executing its powers.
During the Ceremonial Meeting and Formal Reception the Council was congratulated by: the first Chairman of the High Council of Justice of Ukraine Valeriy EVDOKIMOV, the Ukrainian Parliament Commissioner for Human Rights Nina KARPACHOVA, Deputy Chairman of the Chairman of the Constitutional Court of Ukraine Suzanna STANIK, Deputy Chairman of the High Council of Justice of Ukraine Mykola SHELEST, Provost on Scientific Issues of the Yaroslav Mudriy National Academy of Law Anatoliy HETMAN, Deputy Minister of Justice of Ukraine Inna YEMELYANOVA, Chairman of the High Economic Court of Ukraine Serhiy DEMCHENKO, Chairman of the High Administrative Court of Ukraine Oleksandr PASENUK, Chairman of the High Qualification Commission of Advocacy to the Cabinet of Ministers of Ukraine Volodymyr VYSOTSKYY, Deputy Chairman of the Council of Judges of Ukraine, judge of Supreme Court of Ukraine Vasyl HUMENYUK, Chief of Party at USAID Ukraine Rule of Law Project David VAUGHN, member of the HCJ of the first cadence, Adviser to the Chairman of the High Council of Justice of Ukraine Yuriy POLTAVETS, Rector of the Academy of Advocacy of Ukraine Tetyana VORFOLOMEEVA and others.

The regular session of the High Council of Justice of Ukraine took place. During the session the decision was taken to forward submissions to the President of Ukraine regarding appointment of 21 candidates to the position of judges of local administrative? Local economic and local general courts. 10 candidates were refused.
The Council also took a decision to forward submissions to the President of Ukraine and the Verkhovna Rada of Ukraine regarding dismissal from office of 4 judges on general reasons.
Having considered the recommendation of the Qualification Commission of Judges of Economic Courts of Ukraine and the HCJ's member proposal, the Council took a decision to forward submissions to the Verkhovna Rada of Ukraine concerning dismissal from office of 2 judges because of oath violation, namely: Anatoliy SHKURAT, judge of economic court, Kyiv; Vasyl BAIDAK, judge of Zamostianskyy district court, Vinnitsa.
The HCJ found no reasons for the dismissal of the judge of appeal court, 2 judges of local economic courts and 18 judges of local general courts from office because of oath violation and adopted the results of the HCJ's members examination of the information given in the request of the national deputies of Ukraine, officials' and citizens' claims concerning these judges.
Besides, the Council also declined the recommendations of Qualification Commission of Judges and proposal of the HCJ's member on adoption of the submissions for the dismissal of 2 judges of general courts from office because of oath violation.
The High Council of Justice also satisfied the claims of 2 judges of local general courts on the decisions of the appropriate Qualification Commissions on calling them to disciplinary liability, having abolished these decisions and closed disciplinary proceedings in the case.
At the end of the session the Council took a decision on forwarding submission to the Verkhovna Rada of Ukraine and the Cabinet of Ministers of Ukraine regarding awarding officials of the Secretariat of the High Council of Justice with the "Honorary diploma of the Verkhovna Rada of Ukraine" and "Honorary diploma of the Cabinet of Ministers of Ukraine" for exemplary execution of their duties, significant contribution to realization of state legal policy, participation in formation of the highly professional judicial corps of independent Ukraine and because of 10th years anniversary of the High Council of Justice. Under the Council's decision a group of Secretariat's officials will be honored with the "Honorary Decoration of the High Council of Justice" and "Honorary Diploma of the High Council of Justice".

Under the chair of Lidiya IZOVITOVA, the Chairman of the High Council of Justice, the session of the Council took place. During the session the decisions were taken to forward submissions to the President of Ukraine regarding appointment of 6 candidates to the positions of judges of appeal courts, 8 candidates to the positions of judges of local administrative courts, 2 candidates to the positions of judges of local economic courts and 12 candidates to the positions of judges of local general courts. 2 candidates to the positions of judges of appeal courts were refused.

February 20, 2008

After a long interval, concerning the absence of quorum, the session of the High Council of Justice took place. There were present 14 of 17 full members of the Council. HCJ's member ex-officio, the Chairman of the Supreme Court of Ukraine, Mr. Vasyl ONOPENKO, as well as HCJ's members, the judge of the Supreme Court of Ukraine, Mr. Anatoliy SKOTAR and the judge of the Kyiv appeal cort, Mr. Anton CHERNUSHENKO, didn't attend the HCJ's session without any explanations.
At the beginning of the session the Chairman of the High Council of Justice presented the member badge of the HCJ to Mykola ONISHUK, who is the Council's member ex-officio. He participated in the session for the first time after his appointment to the position of the Minister of Justice of Ukraine and taking his oath as the HCJ's member in the Parliament.
During the session the decisions were taken to forward submissions to the President of Ukraine regarding appointment 39 candidates to the positions of judges in district administrative courts, local economic courts and local general courts as well as the submissions to the President of Ukraine and the Verkhovna Rada of Ukraine regarding dismissal of 25 judges on general grounds.
Having considered the letter of Oleksandr SHLAPAK, the First Deputy Head of the Secretariat of the President of Ukraine – representative of the President of Ukraine to the Cabinet of Ministers of Ukraine, № 31-02/1728 from 25 December 2007, by which the materials of the submissions adopted by the decisions taken on 1 August, 12 September and 5 December 2007 regarding appointment 185 candidates to the positions of judges and dismissal of 9 judges were returned, the Council repeatedly forwarded the submission to the President of Ukraine regarding the mentioned candidates to the positions of judges and the dismissed judges.
The Council found no reasons for adoption of the submissions regarding dismissal from office of 42 judges of local general courts, economic and district administrative courts, as well as 8 judges of appeal courts, economic courts of appeal and administrative courts of appeal because of oath violation. The HCJ adopted the results of the HCJ's members examination of the information given in the request of the national deputies of Ukraine, officials and citizens' claim concerning these judges.
Besides, the Council found no reasons for opening disciplinary proceedings regarding 12 judges of the Supreme Court of Ukraine, 1 judge of the High Administrative Court of Ukraine and took a decision to adopt the results of the HCJ's members examination of the information given in the request of the national deputies of Ukraine and citizens' claim concerning these judges.
The High Council of Justice satisfied the claims of 14 judges of local general an local economic courts, 1 judge of the appeal court regarding the decisions of the appropriate Qualification Commissions of Judges on calling them to disciplinary liability, having abolished these decisions and closed disciplinary proceedings in the case. The Council also satisfied the claims of Oleksander LAVRYNOVYCH, the former Minister of Justice of Ukraine, on the decisions of the appropriate Qualification Commissions of Judges on calling of 7 judges of local courts to disciplinary liability, having abolished these decisions and closed disciplinary proceedings in the case.
Under the proposal of Vasyl ONOPENKO, the Chairman of the Supreme Court of Ukraine, from 7 November 2007 the Council took a decision to forward a submission to the Verkhovna Rada of Ukraine regarding dismissal from office of the judge of Dniprovskyy district court, Dneprodzerzhynsk, Dnipropetrovsk region, because of entering into force of the guilty verdict concerning this judge.
The HCJ adopted the information of Lidiya IZOVITOVA, the Chairman of the HCJ, on the results of the Council's activities in 2007; report on the use of the budgetary funds of the HCJ in 2007 foreseen by the budgetary program "Formation of the judicial corps and control under its activities", as well as Action Plan on preparation and celebration of 10 years of the High Council of Justice.
At the end of the session the Council took a decision for honoring with the Honorary Decoration of the High Council of Justice of Ukraine of the group of judges for lasting conscientious work and considerable contribution to execution of justice.
