A trademark is any symbol, sign or designation. But words, number, images and their combinations receive legal protection as a trademark only after their registration. For registration shall be filed application to Ukrainian Patent Office – Ukrainian Intellectual Property Institute (Ukrpatent). An examination is carried out for each Application. Registration process:

Trademark registration process in Ukraine

To start the registration:

• You can e-mail us on info@tm.ua. Write a free content letter. For example: "Trademark Registration for the legal entity (or - individual). Please send a set of documents and a description of the procedure". Or: "I need trademark registration and domain UA. Registration for the legal (or individual) person". Please also indicate contact person and methods of communication in the letter.
If you have particularly difficult problem, then specify in the subject line: "to a Patent attorney Kondratiuk Igor."

Costs of preparing and filing Application for trademark registration - only  $140

Registration deadline:

There are 2 terms of trademark registration in Ukraine: standard and fast.
• Standard registration. This registration has one drawback - it lasts a little more than 2 years. But your have the right on a sign from the date of submitting application for registration. Such TM registration has minimal cost.
• Fast registration. In this case, six months after the submissions of the Application accelerated examination will be ordered. So this registration lasts 7-7.5 months. Advantage: protection document always better than Application.
The cost of Standart and Fast registration depends essentially on the number of classes. Classes of goods and services for trademark registration are selected according to the "International Classification".

Trademark search process

    Search consists of a legal analysis whether your trademark does not violate public order, principles of humanity and morality. As well we chek your mark on the identity and similarity with already registered Trademarks. It is held, either before filing the application for registration, or immediately after application. Sometimes it is better to apply before search. 
    Then your right on TM appears from the date of filing. And only then (!) after a week or two search will be made. Then your application will be in the search results. But this method is good when you are not in a hurry. In all other cases search must be made in the beginning, before applying.
    The cost of search depends on the number of classes you want to register your Trademark for and the kind of sign (verbal, figurative, combined). Cost of verbal mark preliminary search in one class - only  $150

The national phase of the PCT in Ukraine

PCT patent National phase

If you own a patent obtained under the PCT (Patent Cooperation Treaty) our Agency will help you to pass the national phase of this procedure on the territory of Ukraine quickly and easily.
We must note that the deadline for entering the Ukrainian national phase - 31 months from the priority date. Of course, you can restore the prescribed period in Ukraine for 12 months from the missed deadline, but you need to pay additional fees for such a restoring.
In order to start the work by the patent national phase you need:

2. Send an e-mail on info@tm.ua and let us know about patent information, which is necessary to apply for registration in Ukraine.
3. Pay for the services of our agency and official fees.

PCT process in Ukraine.

The national phase of the PCT patent in Ukraine is the filing and consideration of an international application for an invention in Ukrpatent. In Ukraine, the international application has the same date as the national application. And it begins with the international filing date of the application.
Only Ukrpatent can decide to grant protection to an invention filed under an international application. If the Applicant fails to pay the required fee whether or not you will submit the necessary documents, his Application for an invention will be deemed not filed.
The National phase begins only when the Applicant takes certain actions to do so. Ukrpatent does not send any notification to the Applicant with an offer to implement the National phase. Any actions on the Application must be conducted by the Applicant through the Ukrainian Patent attorney.
The national phase includes:
  • Submission by the Applicant to Ukrpatent of the translation of his Application into Ukrainian;
  • Payment of state fees and further consideration of the Application.
    • The competent authority for conducting an international search for a national application is the Ukrainian Institute of Intellectual Property (Ukrpatent).

    Invention and utility model patents

    In Ukraine, there are not only invention patents. Also there are utility model patents.
     The main advantages of the utility model:
    • There is no qualification examination. A patent will be obtained based on the decision of the Formal examination.
    • The time required to get a decision on the Application is much shorter. For example, a utility model should be patented within 6-8 months at most (or faster). Then the invention requires a period of at least 1.5 years.
    • Much lower cost. There is no payment for the examination.
    • Utility model and invention rights are the same.
    Therefore, if patenting is carried out, for example, only in Ukraine or Russia, we recommend obtaining a patent for a utility model.
