The Belarus KGB held me for 11 months seeking for confession to crimes I had consistently denied, before I was able to see a judge. Following a show trial on charges like those often used by Belarus against human rights activists and the political opposition, my factory was expropriated and I was sentenced to six years of prison in a Belorussian labor camp. It was severe physical and psychological abuse during my six years of imprisonment, sharing prison cell with dozens of inmates, being forced to work six days a week, and even being forced by prison guards to watch President Alexander Lukashenko’s live televised speeches. Throughout my lengthy imprisonment in Belarus, which I as foreign investor was forced to serve in full, I refused to concede my guilt and refused to relinquish my shareholding in United Pipe Export Company Trading A.G., which was repeatedly forced by Belorussian officials. INCEPTION The idea to build a metallurgy steel pipe plant never left me since 1998. I really needed this, I know how to manage the plant and how to act on the market of steel seamless pipes, I have seen the error of existing enterprises and opportunities for new one. The only thing to be determined it is the location for build future metallurgical plant. I had ordered documentations to Metallurgical Institutes in Ukraine (GIPROMEZ) and Russia (MIPMZ) as technical so economical research for Pipes Works. After carefully studying provided documentations my choice for set up the Pipes Working Plant fell on Belarus. In 1999 was registered in the Free Economic zone city Gomel Belarus as foreigner enterprise UPECO INDUSTRIES, in 2002 was produced first pipes 2004 was registered trade mark BTZ “Belorussian Tube Works” Here is the list of the documents issued Belarusian authority: Certificate of assignment of customs number from 2004 Certificate of state registration of 24.04.2002 Certificate of the Belorussian Chamber of Commerce and Industry on the products of its own production 14.03.2005 Certificate of the Belorussian Chamber of Commerce and Industry on the products of its own production 20.01.2003 Certificate of the Belorussian Chamber of Commerce and Industry on the products of its own production 18.03.2004 Certificate of the conformation of the statutory fund was fulfilled Confirmation of bank accounts License for guarding the territory of the plant License for processing goods in the customs territory in the plant License to assign a trademark to the plant The certificate on intellectual property The license for wholesale trade The license to attract foreign labor Belorussian Tube Works was produced seamless steel pipes for purpose of the machinery, Gus and oil, building contraction and other industrial needed. The plant worked within four shift 24 hours, has more than 300 staffs, representations in Russia, Ukraine, Italy and Switzerland. In first three years was produced more than 3000 tn of seamless steel pipes. Our clients were as Belorussian company’s so European company’s as well. We had supply pipes to Germany, Italy, Poland, Estonia. We had international certificates and was recognized by International Tube Association. OUR HISTORY IN PHOTOS In May 2005 Director and Owner Gennady Mykhailenko of the BTZ was arrested by Belorussian KGB Belarus expropriate our clients’ factory for the production of cold-shaped seamless steel pipes, the first of its kind in Belarus, but following the illegal arrest and lengthy detention without charge by the State Security Agency of Belarus (the Belarus “KGB”) of Mr. Mykhailenko, a foreign investor, as well as an obvious show trial that made a mockery of both justice and due process, Belarus forced our client to spend six full years in a Belarus labor camp in dreadful conditions, being forced to work six days a week and sharing a cell with dozens of other prisoners. To add insult to injury, this foreign investor was forced on a regular basis by prison guards to watch President Lukashenko’s speeches on television, and to listen to them being read to him by guards. Moreover, as regular communication, let alone management of his associated businesses, was impossible due to his imposed captivity in Belarus for six years, the investor’s related businesses and investments quite foreseeably fell into ruins and he lost, quite literally, everything he owned and his life’s work due to the wrongful acts of Belarus. “ William Kirtley – The lawyer of Gennady Mykhailenko HELP ME OBTAIN THE JUSTICE Association for Human Rights Defense International (HRD) 113 Barksdale Professional Center, Newark, DE 19711, USA.
