Olena Perepelynska spoke at the III International Legal Forum on International Trade Law and International Commercial Arbitration ICC Lex Mercatoria

Olena Perepelynska, Counsel with Sayenko Kharenko, spoke at the III International Legal Forum on international trade law and international commercial arbitration ICC Lex Mercatoria “Bank guarantees and government procurement in international trade and international commercial arbitration” (the “Forum”), which took place on 28 November in Minsk.

The most important topic of this year’s Forum was a bank guarantee under URDG, its form, content, validity and independence, as well as bank guarantees in public procurement. The program of the Forum included a series of roundtable discussions led by the best specialists in the fields of international arbitration and banking law: partners of the leading law firms, international arbitrators, prominent academics; as well as a panel discussion with the participation of the most respected experts in the above mentioned fields of law.

In her presentation “The peculiarities of public procurement in Ukraine with the participation of foreign entities. Arbitrability of disputes under public procurement contracts”, Olena spoke about the history of Ukrainian public procurement legislation, current situation and planned reforms in the field of public procurement in Ukraine, major novels and a current scope of the procurement law application, as well as the arbitrability of disputes arising under public procurement contracts pursuant to Ukrainian legislation. Olena also took part in a panel discussion on the specifics of national regulation of bank guarantees.

Mrs. Perepelynska also acted as arbitrator in the III International Students moot court competition in the international trade law and international commercial arbitration. The goal of the ICC Lex Mercatoria moot court competition? is to stimulate the study of the international private law and to popularise the international commercial arbitration as an alternative means of settlement of commercial disputes in the light of the intensified international economic relations and high demand for the efficient tools to settle legal conflicts.
