VERIZON WIRELESS YOU & YOURS CONTEST
OFFICIAL RULES

NO PURCHASE NECESSARY TO ENTER OR WIN.  PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.  VOID WHERE PROHIBITED BY LAW. 

1.  Eligibility.  Open to legal U.S. residents eighteen (18) years of age or older who reside  in Northern California. Employees and their immediate family members (parent, siblings, children and spouse, and person residing in the same household whether related or not) of Verizon Wireless (“Sponsor”) and its parent and affiliated companies, subsidiaries, and advertising and promotion agencies, and all other companies associated with the Contest, and their respective agents, officers, and directors, and all individuals, including, but not limited to, consultants, independent contractors, so-called “temporary employees,” former employees and interns (and their immediate family members) who have, within the past six months, performed services for Sponsor, are not eligible to enter or win. 

2.  Contest Period.  The contest (“Contest”) begins on November 10, 2012 at 12:00 p.m. PDT and ends on December 10, 2012 at 7:00 p.m. PDT (the “Contest Period”). 

3.  Phase One: Entry and Composition Judging Criteria.  To enter the Contest, entrants must do the following:

From November 10, 2012 at 12:00 p.m. PDT until December 10, 2010 at 7:00 p.m. PDT, go to www.raiders.com and complete and submit the online entry form.  Your submission must include (1) a photo of you, and (2) a written composition (500 words or more) that talks about why your family should win the Ultimate flyaway opportunity.  All submitted entries, including Compositions, become the sole property of Sponsor and will not be returned.  Receipt of entries will not be acknowledged.  Incomplete entries are void.  Sponsor reserves the right to edit, reject or remove any submitted material from consideration based on grammatical errors, content, taste, or any other similar factors in its sole discretion. 

Entrants will be judged based 100% on the “compelling nature” of their Composition by a panel of judges consisting of Sponsor’s employees and/or duly authorized representatives.  All facts and circumstances described in the Composition must be truthful; falsification of any information is a basis for immediate disqualification.  Sponsor may, in its discretion, require that entrant provide substantiation for any factual statements included in the Composition. 

Three (3) semi-finalists (“Semi-Finalists”) will be selected by Sponsor based on the evaluations of the Compositions by the judges and corresponding point totals assigned to each Composition.  In the event of a tie regarding the Composition point totals, the judges will confer and determine the order of scoring for the entrants.  THE DETERMINATION OF THE SEMI-FINALISTS SHALL BE MADE BY SPONSOR IN ITS SOLE DISCRETION, AND SUCH DETERMINATION SHALL BE FINAL AND BINDING.  IF YOU DO NOT AGREE WITH THE ABOVE CRITERIA FOR JUDGING THE COMPOSITION AND SELECTING THE SEMI-FINALISTS, DO NOT ENTER THIS CONTEST.

Semi-Finalists will receive an email from Sponsor regarding his or her selection as a Semi-Finalist.  The notification will contain terms and conditions (“Terms and Conditions”) for the Semi-Finalist’s participation in Phase Two and provide an opportunity for the Semi-Finalist to respond to the email by a specified date and accept or reject them.  If Semi-Finalist timely responds to the email and affirmatively agrees to these Terms and Conditions, he or she will advance to Phase Two.  If Semi-Finalist timely responds and rejects the Terms and Conditions, or fails to timely respond to the email, he or she will be automatically disqualified from the Contest and will not proceed to Phase Two.  Should this occur, Sponsor will have the option, but not be required, to select an alternate Semi-Finalist to replace the disqualified Semi-Finalist, and such replacement Semi-Finalist will likewise be required to agree to the Terms and Conditions as a condition of proceeding to Phase Two.  In addition, selected Semi-Finalists shall also receive information containing the Terms and Conditions, which shall include a document to be signed by a custodial parent or legal guardian providing authorization and consent to participate in Phase Two, which must be returned to the Sponsor by fax, email, or U.S. mail.

4.   Phase Two:  Commenting Period.  During Phase Two of the Contest, members of the public will have an opportunity to comment on the Semi-Finalists compositions.  

The Grand Prize Winner will be determined by Sponsor in its sole discretion based on the composition percentage and the nature of the comments elicited through www.raiders.com.  The Grand Prize Winner shall be notified by phone, email, text message, or U.S. mail and, if possible (but not guaranteed), an in-home notification by Sponsor media representatives.  In the event of a tie, winner selection from among the tied semi-finalists will be based on the Composition point totals from Phase One.

5. Winner Selection:   The grand prize winner will be determined as outlined above on or about December 12, 2012.  All properly claimed prizes will be awarded.  As a condition of winning the prize, winners must complete, sign and return an affidavit or eligibility and liability and publicity release, where permitted by law, and any other applicable forms required by a taxing authority, and travel companion must complete, sign and return a liability/publicity release, where permitted by law, within 2 days of receipt of written prize notification or prize will be forfeited and an alternate winner selected.  If any prize is returned as undeliverable, the corresponding prize will be forfeited and will be awarded to an alternate winner.  Should a winner make any false statement(s) in any document referenced above, the winner will be required to promptly return to Sponsor his/her prize.  Any unclaimed prizes may be awarded in subsequent random drawings to be held as necessary.  By accepting prize, entrants consent to Sponsor’s use of their name, photograph and/or likeness, address, voice, and statements made by or attributed to them, in perpetuity, in any and all media now known or hereafter developed (including, without limitation, print, broadcast and Internet), for all legitimate business purposes including advertising and promotional activities without additional compensation, unless prohibited by law. Upon delivery to the winner’s address, Sponsor will be deemed to have awarded the prize to the winner with winner assuming full responsibility for the prize

6.  Prizes.  One (1) Grand Prize Winner will receive a flyaway for winner and a guest to attend the San Diego Chargers v. Oakland Raiders game on December 30, 2012 at Qualcomm Stadium in San Diego, California. Approximate retail value (“ARV”): $800.00, depending on point of departure.

The prize consists of round trip air transportation for winner and a guest from a major airport in Northern California to San Diego, California; transportation to and from the hotel in San Diego to game and airport; one-night hotel stay (standard room, double occupancy) for the winner and guest (room rate and taxes only; size and type of room determined by Sponsor); stay restrictions may apply.  If winner is not available for the trip on the dates specified by Sponsor, the prize will be forfeited.   The winner and guest must travel together on same itinerary and are responsible for obtaining all required travel documents.  Travel and accommodation restrictions and other restrictions may apply.  Sponsor is not responsible for travel delays or cancellations.  The exact value will depend on where the winner resides and market conditions at the time of prize fulfillment.  All federal, state, local taxes on the prize value, if applicable, are the responsibility of the winner.  An IRS form 1099 will be issued in the winner’s name if required by law.  The prizes will be awarded if properly claimed.  No substitution, cash redemption or transfer of the right to receive any prize is permitted, except in the discretion of Sponsor, which reserves the right to substitute a prize of equal or greater value.  Prizes consist only of the items expressly specified in these Official Rules.  All prize details will be determined by Sponsor in its discretion.  All expenses or costs associated with the acceptance or use of any prize or any component thereof that are not expressly listed in these Official Rules (including without limitation meals, trip insurance, souvenirs, gratuities and incidentals) are the responsibility of the winner

ALL FEDERAL, STATE, AND LOCAL TAXES AND FEES, INCLUDING INCOME TAX, SALES TAX AND LICENSE FEES, AND ANY OTHER EXPENSES ARISING OUT OF THE RECEIPT AND USE OF THE PRIZES, ARE SOLELY THE RESPONSIBILITY OF THE WINNER OR WINNER’S PARENTS OR LEGAL GUARDIAN.  ANY DIFFERENCE BETWEEN THE STATED ESTIMATED VALUE OF A PRIZE AND ITS ACTUAL VALUE WILL NOT BE AWARDED.  WINNER AGREES TO ACCEPT PRIZE “AS IS.”

7.  Restrictions.  Prize is nonrefundable and nontransferable.  Sponsor is not required to offer any substitutions, cash redemptions, or alternative to prizes awarded under this Contest.  Sponsor reserves the right to substitute a prize of equal or greater value in the event a prize is unavailable.  Recipient of prize must have a U.S. mailing address.  All prizes awarded are subject to the restrictions and limitations noted in these Official Rules.  Odds of advancing from Phase One to Phase Two, and odds of winning, depend upon number of entries.

8.  General Entry Rules.  Any individual who attempts or otherwise encourages, directly or indirectly, false contact information under multiple identities, by cellular phone, Internet, or otherwise, or uses any device or artifice to enter or encourage, directly or indirectly, multiple or false votes or entries, as determined by the Sponsor or Contest Administrator, will be disqualified.  The use of automated voting devices or any other conduct that impedes the integrity of the Contest is prohibited.  Mutilated, lost, illegible, corrupted, or incomplete entries will be deemed ineligible and disqualified.  In the event of a dispute, entry information will be declared made by the authorized account holder of the telephone number/email address submitted at the time of entry.  “Authorized account holder” is defined as the natural person who is assigned to a telephone number/email address by a telephone company, wireless service provider, Internet access provider, Internet service provider or other organization (e.g. business, educational, institution, etc.) that is responsible for assigning email addresses, telephone numbers or wireless phone numbers for the telephone exchange associated with the submitted telephone number/email address or the domain associated with the submitted telephone, as applicable.

Sponsor, together with any Co-Sponsor, and Contest Administrator, and their respective parents, subsidiaries and affiliates, advertising and promotion agencies, suppliers (including all prize providers), printers, and distributors, and the respective officers, directors, employees, representatives and agents of each and any other person or entity related in any way to this Contest (collectively “Contest Entities”), are not responsible for late, lost, incomplete, misdirected, or damaged entries or for technical, hardware, software or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the sender, or by any of the equipment or programming associated with or utilized in this Contest which may limit the ability to play or participate, or by any human error that may occur in the processing of the entries in this Contest, or for any printing errors in these Official Rules.  If for any reason (including infection by computer virus, bugs, worms, tampering, sabotage, natural disasters, acts of God, unauthorized intervention, fraud, technical failures, or any other cause beyond the reasonable control of Contest Entities that corrupts or affects the administration, security, fairness, integrity, or proper conduct of this Contest) the Contest is not capable of being conducted as described in these Official Rules, Sponsor shall have the right, at its sole discretion, to cancel, terminate, modify or suspend this Contest, and select the prize winner(s) from entries received prior to the action taken, or as otherwise deemed fair and appropriate by Sponsor.  Sponsor reserves the right to prosecute any fraudulent entries to the fullest extent of the law.  At Sponsor’s sole discretion, entrants, winners and guests who do not comply with these Official Rules or attempt to interfere with this Contest in any way may be disqualified.

9.  Release and Indemnification.  By entering, entrants and winner(s) agree to be bound by these Official Rules and the decisions of Sponsor, together with any Co-Sponsor and Contest Administrator, which shall be final for all purposes hereunder, and agree: (1) Contest Entities may use (unless prohibited by law) their names, likenesses, images, photographs, voices, cities/states of residence, and biographical information for advertising, trade and promotion in any media or format now or hereafter known, including on the Internet or via wireless application protocol, without further compensation, permission or notification, except where prohibited by law; and (2) to release, hold harmless and indemnify Contest Entities from and against any and all liability, damages or causes of action (however named or described) with respect to or arising out of either (i) entrants’ participation in the Contest or in any Contest-related activity; or (ii) the receipt, possession, or use or misuse of the prizes awarded in the promotion, including but not limited to, any claims for damage to property, personal injury or death, or claims based on defamation, rights of privacy, rights of publicity or merchandise delivery.  Winner will be required to complete, sign and return an Affidavit of Eligibility and Publicity/Liability Release or prize may be forfeited and awarded to an alternate, and winner’s parent or legal guardian will be required to execute an affidavit acknowledging, confirming and consenting to the liability release and advertising consent as set forth above.

10.  Miscellaneous Conditions.  Except to the extent preempted by federal or other applicable state law, the Contest shall be governed by the laws of the State of New Jersey, without giving effect to any conflict of law provisions thereof.  By participating in the Contest, entrants agree that any and all disputes which cannot be resolved between entrant and Sponsor, and causes of action arising out of or connected with this promotion, shall be resolved individually, without resort to any form of class action, exclusively before a court located in the County of Somerset, State of New Jersey, having competent jurisdiction, which court shall apply the laws of the State of New Jersey without giving effect to any conflict of law provisions thereof.  Any personal information supplied by any entrant to Contest Entities will be subject to Verizon Wireless’ privacy policies posted at http://www.verizonwireless.com.
