The 13-th Session of the Interstate Council of Industrial Property Protection (ICIPP)
and Regional Seminar of the World Intellectual Property Organization (WIPO)  

“Ten years of cooperation in the field of industrial property in CIS countries and its future prospects”

The delegation of the State Department of Intellectual Property headed by its Chairman Mr. Mykola Paladiy, the plenipotentiary of Ukraine in ICIPP, took part in the 13-th ICIPP session held on 13-14 March, 2003 in Kishinev, Republic of Moldova.
At the session there were presented plenipotentiaries of the CIS member countries of ICIPP, observers from the World Intellectual Property Organization (WIPO), Eurasian Patent Office (EAPO), European Patent Organization (EPO), CIS Executive Committee, Coalition for Intellectual Property Rights (CIPR), International Federation of the Phonographic Industry (IFPI), as well as representatives of Georgia, Turkmenistan and Uzbekistan.
During the session there were considered the following issues:
  • performance of the Interim Working Group in discussing the issues concerning the support of small and medium-size businesses; promotion of innovative activity; accounting and estimation of the intellectual property value; implementation of rights and consideration of the state interests regarding the intellectual property created at the expense of the state budget;
  • cooperation in the field of informational and technical support to the patent offices, including the results of the first year’s industrial production of “CISPATENT” CD-ROM and schemes of its release for 2003, the state of affairs regarding the technical and legal aspects of electronic filing in a national patent office;
  • partial progress of harmonization of the national legislations with the norms of the international agreements in the field of industrial property – the Patent Law Treaty (PLT), the Trademark Law Treaty (TLT), the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS);
  • a draft Agreement on Establishment of the International Register of Appellations of Origin for the member states of the Agreement on Measures to Prevent and Terminate the Use of False Trademarks and Geographical Indications of June 4, 1999;
  • measures on execution of the CIS Economic Council resolution “On the Package Plan of Realizing the Concept of CIS-States’ Interstate Innovation Policy for the Period up to 2005” ;
  • cooperation in the field of implementation of rights to industrial property objects in the member states of ICIPP;
  • interaction between ICIPP and Joint Working Commission of the member states of the Agreement on Cooperation for Prevention of Intellectual Property Rights Infringements;
  • a draft Appeal to the Heads-of-Government Council of CIS countries for more attention to be paid to intellectual property protection and the role of national patent offices to be more vital;
  • the election of ICIPP Chairman and Deputy Chairman.

The session program provided for the election of ICIPP officers. Mr. Roman Omorov, the plenipotentiary of the Kyrgyz Republic was selected the new Chairman of ICIPP for the term of three years. Mr. Mykola Paladiy, the plenipotentiary of Ukraine was unanimously elected the Deputy Chairman.

During the 13-th ICIPP session there was signed the Agreement on Cooperation in the Field of Intellectual Property Protection between the Ministry of Education and Science of Ukraine and the Russian Patent and Trademark Office.

Cooperation within the bounds of this Agreement is to regulate issues connected with obtaining, exercising, effecting and protecting rights to any intellectual property objects; to improve application filing and protective document issuing procedures; to harmonize national acts of legislation in the field of intellectual property with the norms of international agreements; to manage general measures and take them into effect, etc.

On the eve of this ICIPP session, on 12 March there was taken place the meeting of the Working Group on harmonizing national Laws the sitters thereof considered the actual state of doing the work aimed to harmonize national acts of legislation with the norms of international agreements in the field of industrial property as well as a draft Agreement on Utility Model Mutual Recognition.

Besides, within the scope of this ICIPP session there was held the meeting of the Working Group on discussing the issues of supporting small and medium-size business, promotion of innovative activity, accounting and estimation of the intellectual property value, implementation of rights and consideration of the state interests regarding the intellectual property created at the expense of the state budget. There were also discussed a draft Provision on Interim Working Group and its Work Plan. These documents were submitted to plenipotentiaries in ICIPP. The Council approved both Work Plan and Provision on Interim Working Group.

Representatives of the State Department of Intellectual Property of Ukraine contributed their share to the work of all Working Groups stated above.

Within the scope of the 13-th ICIPP session the Regional WIPO Seminar “Ten years of cooperation in the field of industrial property in CIS countries and its future prospects” coordinated with WIPO was held on 11-12 March. The representatives of the Government of Republic of Moldova, WIPO, European Patent Organization, Eurasian Patent Office, CIPR, members of delegations of Member Patent Offices of ICIPP participated in this Seminar. The reports were devoted to the following:

The promotion of market economy by improvements in the use of industrial property in CIS-countries: ICIPP role therein.

The importance of industrial property protection to economical and cultural progress in CIS countries.

The role of the Eurasian Patent Office in the world patent system and its trends.

Updating CIS countries’ laws in the field of industrial property: the current situation and future prospects.

The protection of geographical indications in CIS countries.

Using patents as a technological information source in CIS countries.

Updating the national system of industrial property in accordance with the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS) by the example of Kyrgyzstan.

Strengthening cooperation of state and private sectors: ICIPP role in coordination of intellectual property protection at the regional level. The viewpoint of copyright holders.

The Seminar summary was considered during a round table discussion “The ICIPP role in coordination and promotion of cooperation in the field of intellectual property – Tasks for the future.” held on March 12.

The issues considered during the Seminar, round table and ICIPP session are of extraordinary importance both for the development of national systems of intellectual property legal protection and for the international cooperation.
