Such investigation was initiated by Myronivsky Hliboproduct, Dniprovsky poultry processing plant and Ruby Rose Agricole company. In these proceedings, AstapovLawyers represented Perdue Farms, one of the major US-based chicken producers. "We noted some discrepancies in the statistical data and revealed inconsistencies between the producers' export and import prices during product importation by the traders in Ukraine. It should be noted that mandatory requirements for the introduction of antidumping measures include losses of a national producer and the cause-and-effect relation between dumped imports (if any) and material losses incurred by a national producer. The main question before us was the availability of most such elements", says Oleh Malskyy, AstapovLawyers' Partner. This investigation brought positive results for our client due to strong support of US and local lawyers, interest shown to this matter by the USA Poultry & Egg Export Council (USAPEEC), US Government and Embassy. It is also worth noting that should the Ministry of Economy have applied antidumping measures, it could be quite possible that American producers had to seek judgment from the World Trade Organization (WTO). Notwithstanding a time-consuming dispute resolution procedures of the WTO, American producers, most probably, would prove their case and such outcome, in its turn, could rather negatively affect the image of Ukraine.
