On July 16, 2009, the Russian Ministry of Industry and Trade arranged public hearing within the framework of an investigation against import of flat rolled stainless steel products into the Russian Federation from the Republic of South Africa, the Republic of Korea, Federal Republic of Brazil, and the People's Republic of China (including Taiwan). The aim of the hearing was to gather the claimants and other interested parties together and have them exchange views on the subject of the investigation. The views and opinions would then be considered by the Ministry of Industry and Trade and the Russian Government when the Ministry would decide on the need for protective duties against stainless steel imports into Russia. Spetsstal Association and Magisters who previously joined their forces to protect the interests of the suppliers and Russian consumers participated in the hearing. The following representatives took part in the hearing on behalf of the claimants: CJSC Volgograd Metallurgical Plant Krasny Oktyabr, OJSC Chelyabinsk Metallurgical Complex, and OJSC Moscow Metallurgical Plant Serp & Molot. Among the interested parties opposed to the preventive customs duties there were representatives of some world's top manufacturers and importers (ArcelorMittal, Acerinox) as well as Russian stainless steel consumers (OJSC Fritex, OJSC Chuvashtorgtekhnika, OJSC Ashi Metallurgical Plant). Andrey Voronin, Executive Director of Spetsstal Association disagreed with the Russian manufacturers declaring the fact of dumping. In his opinion there is no evidence for this. “It is quite natural that implementation of antidumping duties for the import of nickel-containing steel from the EU (total volume ~90%) at the rate of 840 euro/tonne in 2007 caused the increase of import from other countries. Customs value and real price on imported products are not the same. Besides it would be useful to analyse not only the Russian customs statistics – which are obviously not enough to accuse the leading international manufacturers of dumping – but also the same information from the countries involved in the investigation. And preferably before its start". Andrey Voronin adds: "I am very doubtful that the whole world is dumping in the market (Russian) with the consumption capacity less then 0,9% of the total world flat rolled nickel-containing stainless steel production". Oleg Riabokon, Partner, Head of Commercial Practice with Magisters (CIS): "According to the Russian customers of stainless steel many enterprises have to use imported steel as the mill products made in Russia do not meet the quality standards. Thus the statement that the imported steel is identical to the Russian goods is not true. So I can not see any cause-effect relation between the import of flat-rolled mill products and the announced damages to the branch of the Russian industry. In this case the law requires to terminate the investigation". As Oleg Riabokon says, the implementation of the new customs duty will definitely worsen the situation in the Russian market. "First of all antidumping duties will influence Russian manufacturers of food and processing equipment, medical instruments, consumer goods and household appliances who will not be able to compete with international manufacturers in terms of the quality. And as a result - thousands of employees who are involved in the production of goods with maximum added cost and who are on the verge of survival if compared with much more stable positions of the Russian metallurgy. Russian manufacturers are not able to provide the consumers with high quality products as they do not produce it. The indicated resolution of the appellate instance did not satisfy the appeal of VVD LLC (Kyiv) against the decision of the Kyiv Commercial Court from January 22, 2008 on relieving State Enterprise Energoatom NJSEC from the unsubstantiated obligation to pay almost UAH 60 million in favor of aid company. Thus, even the Higher Commercial Court of Ukraine confirmed the fact that Energoatom NJSEC does not have any indebtedness to VVD LLC, and that the claims of this company regarding the payment of UAH 60 million to it by a State company is unfounded. In order to ensure a positive result, the Company’s lawyers worked together with specialists from Magisters law firm. On the part of Magisters, the project was managed by Partners Serhii Sviriba and Alexey Reznikov, with the participation of associates Sergiy Grebenyuk, Igor Semenov and Andrey Sidorenko. In 1999, under the guise of new hi-tech equipment, VVD LLC installed 4 low pressure rotors at the Yuzhno-Ukrainskiy AES (South Ukrainian Nuclear Power Plant). At one time, these rotors were designated for the Krymskiy AES (Crimean Nuclear Power Plant), which was supposed to have operated using sea water, which is why the indicated equipment didn’t apply for use at other nuclear power plants. After the termination of the construction of the Krymskiy AES in 1990, the rotors were dismantled and sold to private enterprises as scrap metal. In time, VVD LLC offered the repaired rotors to Energoatom NJSEC for the Company’s centralized stock. In 2001, VVD LLC filed a claim in the Kyiv Commercial Court for the recovery of UAH 60 million from Energoatom NJSEC, allegedly to ensure settlement with Gentwin Systems, the Irish company-supplier. On February 1, 2002, the Kyiv Commercial Court ruled that the indicated amount should be recovered from NJSEC. As was made apparent in 2007, Gentwin Systems had already been closed down in 2000 for the non-payment of taxes. At that point, Energoatom appealed to the court, asking for previous decision on the recovery of UAH 60 million in favor of VVD to be cancelled. According to valid legislation, in the case of the closing-down of a legal entity, all of its jural relationships are discontinued, except in cases of the existence of a successor. Gentwin Systems did not have any successors, therefore the obligations of VVD before this company were terminated. Specialists in IT sector legal regulation, as well representatives of mass media, attended the meeting. Pavel Sadovsky, Senior Associate at Magisters, shed light on the official regulation issues, related to the creation, distribution and use of software. During the course of discussions, participants noted, that State authorities have not developed an efficient method for investigating crimes related, for example, to the violation of rights to a registered trademark. At the same time, as far as the violation of copy- and associated rights is concerned, such a method, albeit insufficiently effective, does exist. Participants complained that the official regulation of this sector is unable to keep up with the development in digital technologies, and is often of a somewhat formal nature. Thus, the law does not provide for the possibility of concluding a licensing agreement by electronic means. Andrey Silin, Associate at Magisters, highlighted issues pertaining to certification and licensing. Participants examined regulation issues concerning the creation, distribution and use of software, containing protection means for confidential information in great detail. He noted that nearly all programs have such means, however, databases with personal data are available to all legal entities. For this reason, a formal requirement for licensing and certification apply to just about all companies. To all intents and purposes, these requirements are seldom complied with. The book outlines each jurisdiction's view of price fixing along both horizontal and vertical lines, and some of the key exceptions which Governments allow.
