Preliminary qualification
procedure announcement regarding the beginning of selection process of the general developer for the Project "Building of a new terminal complex in a "Boryspil International Airport" State Enterprise realization². In accordance with Law of Ukraine No.2669-IV dated on June 16, 2005 "On the ratification of the Agreement (in the form of Exchange of Notes) between the Government of Ukraine and Government of Japan for financing Boryspil State International Airport Development Project, it is provided the ODA loan by Japan Bank for International Cooperation in the amount of 19.092.000.000 Yen.
Other normative regulations for the Project realization are following:
- Loan Agreement No. UKR-P1 dated 29th March 2005 between Japan Bank for International Cooperation and the Cabinet of Ministers of Ukraine regarding the "Boryspil State International Airport Development Project";
- The Cabinet of Ministers of Ukraine Decree No 938 dated 21st September 2005 "On Boryspil State International Airport Development Project financing";
- Sub-loan Agreement N13000-04/70 dated 22nd September 2005 for "Boryspil State International Airport Development Project" between the Cabinet of Ministers of Ukraine (presented by Ministry of Finance), "Boryspil International Airport" State Enterprise and joint stock company "The State Export-Import Bank".

"Boryspil International Airport" State Enterprise acting within the international and Ukrainian legislation, announces the beginning of selection process of the general developer-contractor for the Project "Building of a new terminal complex in a "Boryspil International Airport" State Enterprise realization.
1. Disbursement of the ODA Loan by JBIC will be subject, in all respects, to the terms and conditions of the Loan Agreement, including the disbursement procedures and the 'Guidelines for Procurement under JBIC ODA Loans'. No party other than the Government shall derive any rights from the Loan Agreement or have any claim to the Loan proceeds.
2. JBIC requires that tenders and contractors, as well as borrowers, under contracts funded with ODA Loans of JBIC and other Japanese ODA, observe the highest standard of ethics during the procurement and execution of such contracts. In pursuance of this policy, JBIC
(a) will reject a proposal for award if it determines that the tenderer recommended for award has engaged in corrupt or fraudulent practices in competing for the contract in question;
(b) will recognize a contractor as ineligible, for a period determined by JBIC, to be awarded a contract funded with ODA Loans of JBIC if it at any time determines that the contractor has engaged in corrupt or fraudulent practices in competing for, or in executing, another contract funded with ODA Loans of JBIC or other Japanese ODA.
The Works consist of the manufacture, delivery, construction, installation, testing, commissioning, completion and maintenance of the following facilities, including all civil, structural, architectural, mechanical and electrical works required, and the remedying of any defects therein.

3. The scope is described in more detail in the Prequalification Documents.
4. The Site is situated approximately 29 kilometres to the southeast of the city of Kyiv.
5. It is expected that Invitations to Tender will be issued during the second half of 2007 for International Competitive Tender in compliance with the "Guidelines for Procurement under JBIC ODA Loans".
6. Construction is planned to commence in the second quarter of 2008 and to complete in the third quarter of 2010 followed by a one year defects liability period.
7. Application for Prequalification is open to firms and voluntarily formed joint ventures, from eligible source countries, in accordance with the "Guidelines for Procurement under JBIC ODA Loans", who possess the experience and capability to execute and complete the whole of the Works. The Eligible Source Countries are defined as "all countries and areas".
8. In the case of voluntarily formed joint ventures, Applications should only be made where all parties to the joint venture are jointly and severally liable for the execution and completion of the Works.
9. The Prequalification Documents prescribe the complete and detailed minimum requirements necessary for qualification but in addition to the financial and other minimum requirements therein, the Applicants MUST comply with ALL of the following essential experience requirements:
(a) Applicants must possess an average annual turnover (defined as billing for works in progress and completed) on construction works as a prime contractor (or as a joint venture partner with a share of not less than 25% in any such joint venture) over the last five (5) years of at least two hundred and fifty million (250,000,000) equivalent United States Dollars.
(b) the successful experience as prime contractor (or as a joint venture partner with a share of not less than 25% in any such joint venture) in the execution and completion of three (3) international air passenger terminal building projects of a size, nature and complexity comparable to the proposed contract within the last ten (10) years.
10. Applicants may purchase the Prequalification Documents upon submission of a written application and upon payment of a non-refundable fee of US$ 200 or UAH 1,000 per set, between Thursday 10st May 2007 and Wednesday 16st May 2007 during normal office hours, by calling, writing or faxing:

11. Applicants who have purchased the Prequalification Documents, and who intend to apply for Prequalification as a Single Contractor or Lead Partner of a Joint Venture, must officially confirm in writing (or by fax) to the Employer at the above address, of their intention to submit an Application for Prequalification, on the Form provided by no later than thirty (30) days before the closing date of the Prequalification Application.12. Submissions of Applications for Prequalification must be received in sealed envelopes, either delivered by hand or by registered mail, to the above address, marked for the attention of the Chairman of the Tender Board, not later than: 3 p.m. (Eastern Europe Time) on Wednesday 27th June 2007, and be clearly marked "Application to Prequalify for Boryspil State International Airport Development Project".
13. Applicants who have purchased the Prequalification Documents but who do not submit by this time and date will be deemed to have withdrawn from the prequalification process.
14. The Employer reserves the right to:
- amend the scope and value of any contracts to be tendered;
- reject any application and late applications;
- cancel the prequalification process and reject all applications.
Neither the Government nor the Employer shall be liable for any such actions nor shall either be under any obligation to inform the Applicant of the grounds therefore.
15. Applicants will be advised of the results of their Applications on completion of the Prequalification Evaluation. Only firms and joint ventures prequalified under this Invitation will be invited to tender.
