From January 1, 2023, the World Intellectual Property Organization will introduce new editions of international classifications of industrial property objects: the 12th edition, the 2023 version of the International Classification of Goods and Services for the Registration of Marks (Nice Classification, MKTP (12-2023)), the 14th edition of the International classification of industrial designs (Locarno Classification, MKPZ-14), the 9th edition of the International Classification of Figurative Elements of Marks (Vienna Classification, MKZEZ-9) and the 2023 version of the International Patent Classification (IPC, MPK-2023.01).

For the convenience of users, we provide links to the texts of the specified classifications translated into Ukrainian, which will be used for the examination of applications for industrial property objects: MKTP (12-2023), MKPZ-14, MKZEZ-9, MPK-2023.01.

IP office: report

Massive missile attacks or the "shahed" drones invasion do not stop Ukrainians, and therefore the work of a united team of the state system of legal IP protection.

From November 8, 2022, the IP office performs the functions of the National IP Authority. During this time, we received (physically, by mail, and in digital format) applications for:

IP Summary 2022

The year 2022 was a test for everyone, but we persevered, were able to complete the reform of the IP sphere, and therefore created the conditions for professional support of the innovative development of Ukraine, which will have great relevance for our society after the Victory.

Despite the full-scale Russian invasion, the national patent office continued to operate. The IP system reacted quickly enough to the challenges of the great war and gave the applicants the necessary support so they would not be deprived of their rights.

Moreover, the sector managed to complete the institutional reform and, thanks to the support of the Ministry of Economy and its head Yulia Svyrydenko, it was possible to fully launch the IP office. It is no longer just an institution that issues IP documents. It should become a high-quality service for the inventor, author, and creator. Its staff has already been formed, its legal status has been determined, the transition of the examiners' corps has been completed, the functions of transferring property and registers have been provided, and access to databases has been opened. From January 1, 2023, the full operation of all state intellectual property protection system components will resume.

The IP office has already started consultations on how it can be useful for the innovation sector, creators and businesses. And although it is not an investment fund, this platform will be able to explain what IP is and how to commercialize and effectively protect it. In addition, work continues with international institutions that are ready to help Ukraine, in particular, in the implementation of the decision of the WIPO General Assembly on the support of innovative and creative sectors and the intellectual property system of our country.

For the field of IP, the year 2022 ends with the adoption of the Law on Copyright and Related Rights, which, together with draft law No. 6464 on strengthening the protection of intellectual property rights, will allow Ukraine to finalize its obligations under the Association Agreement with the EU. And then, there is a new page and a road map for the gradual integration of the Ukrainian IP sphere with the European sphere, as required by the status of a candidate state for joining the EU.

Happy New Year! We believe that 2023 will be a victorious year for Ukraine, and we thank those who contribute to this victory at the frontlines. Our future now depends on them.

For our part, we promise that 2023 will be a year of qualitative changes for the Ukrainian IP sphere. Both the reconstruction of our state and its further innovative development and investment attractiveness depend on this.

Completion of the institutional IP reform, preservation of the ISA/IPEA status, and zero tolerance for corruption: a meeting of the heads of UANIPIO and UIPI with U.S. representatives

The state of the institutional reform of the intellectual property system in Ukraine and the current challenges for the field of IP were discussed at the meeting by the heads of UANIPIO and UIPI with representatives of the U.S. Embassy in Ukraine.

"The newly created IP office is a logical step on the path of institutional reform in the IP sphere, which began back in 2016. We not only preserve but also strengthen the examiners’ corps and will make maximum efforts to improve its qualifications in order to improve the quality of legal protection of intellectual property objects. We take these steps, understanding the need to preserve the ISA status for UANIPIO and the movement of Ukraine as a candidate for EU membership. The IP office will build its activities on the basis of professionalism and transparency. It is fully open to cooperation with all stakeholders in the field. We emphasize zero tolerance for corruption, covert or overt. Our task is to make the service as high-quality as possible, and the field of IP as modern, transparent and innovative as possible,"  Olena Orliuk, the head of the State Organization "Ukrainian National Office for Intellectual Property and Innovations" (UANIPIO), emphasized during the meeting.

Proper implementation of the Decision of the WIPO General Assembly is essential for the national IP system, so representatives of the Ukrainian IP Office thanked the American side for their remarkable support in adopting this decision:

"For the national sphere of intellectual property in Ukraine, cooperation with WIPO is extremely important, including in terms of preserving the status of the International Searching Authority and the International Preliminary Examining Authority. We are interested in prospective areas of cooperation between UANIPIO and the USPTO. It is also important for Ukraine to properly implement the Decision of the WIPO General Assembly А/63/8 of 20.07.2022 "Assistance and Support for Ukraine's Innovation and Creativity Sector and Intellectual Property System," - stressed Bohdan Paduchak, advisor to the head of UANIPIO.

During the communication, the parties also discussed the directions of legislative changes in the field of IP and further steps in their implementation.

"Now we are doing everything to make the transformation processes happen as quickly as possible. During the last period, important legislative changes took place, which required some time to start the full functioning of the system of state protection of IP in Ukraine. The consequences of massive missile attacks on the critical infrastructure of our country have already slowed down the work of the industry, so now we are making every effort to restore the full functioning of the entire IP sphere as soon as possible," emphasized Serhii Marchenkov, head of the State Enterprise "Ukrainian Intellectual Property Institute" (UIPI).

The meeting took place on December 9, 2022, at the U.S. Embassy in Ukraine. The participants were Dorian Mazurkevich, Intellectual Property Attaché at the U.S. Embassy in Ukraine, who also represents the United States Patent and Trademark Office (USPTO); Olena Orliuk, the head of the State Organization "Ukrainian National Office for Intellectual Property and Innovations"; Bohdan Paduchak, adviser to the head of UANIPIO and Serhii Marchenkov, head of the State Enterprise "Ukrainian Intellectual Property Institute."

Dear applicants!

Due to changes in the state intellectual property system, from 00:00 on November 8, 2022, SE Ukrpatent will stop all its activities as National IP office. 

Also, from 00:00 on November 8, 2022, SE Ukrpatent will stop accepting fees for actions related to the protection of rights to intellectual property objects. Bank accounts details of UANIPIO will be made public on November 8, 2022, on this information resource.

On November 8, 2022, the ordinance of the Cabinet of Ministers of Ukraine dated October 28, 2022, No. 943-r "Some issues of the National Intellectual Property Authority" will enter into force, by which the Ukrainian National Office for Intellectual Property and Innovations (UANIPIO) is designated as an entity performing the functions of a National IP Authority and the performance of these functions by the State Enterprise "Ukrainian Intellectual Property Institute" (Ukrpatent) is terminated.

The process of transferring National IP Authority functions from SE Ukrpatent to UANIPIO is underway. We will promptly inform you about all further actions by placing up-to-date information on this resource.

High-quality state service and an innovative hub, not an area where corruption is allowed — Olena Orliuk on the work plans of the IP office

The scope of activity of the new IP office should be aimed not only at improving the legal protection of intellectual property but also necessarily related to innovation, increasing the culture of protection of intellectual property rights, and creating a hub of a full consulting cycle for the inventor. This is both the result of the multi-vector reform implementation in the field of IP and the implementation of those steps that Ukraine must take as a candidate for EU accession. This was announced by the head of UANIPIO, Olena Orliuk, at a meeting with representatives of professional and business associations.

"Our functionality is expanding, and we are considering the development of the IP sphere in an inextricable connection with innovations. The IP office sees its active role in building the innovative ecosystem of the country. Our goal is a high-quality service to help Ukraine be innovative and reputationally attractive both for national business and the countries that currently support us, and we could ensure the development of the national economy after our victory over the aggressor. The office considers itself in the full cycle of the National Intellectual Property Authority, including as a professional platform for IP promotion, and the development of IP culture, as this is important for the development of a European-level state. The IP sphere can no longer be perceived as a sphere where corrupt actions are allowed."

In addition, Olena Orliuk emphasized the importance of maintaining an expert environment, attracting young personnel, and creating high-quality databases, information resources, and the IP office website.

"The IP office is interested not only in preserving the examiners' corps that worked in Ukrpatent but also in bringing back those specialists who left the patent office in recent years, training young specialists and giving them the opportunity to work in the IP office. We are interested in improving the examination quality and in constantly improving the qualifications of the examiners' corps. One of the next steps is the resumption of training and certification of patent attorneys. After all, we are interested in supporting national inventors and startups, attracting businesses to invest in science and inventions. Our databases, our information resources, and the site must be brought in line with European practices since Ukraine is on the way to joining the EU."

The meeting with representatives of professional and business associations took place as a result of the adoption of the order of the Cabinet of Ministers of Ukraine, "Some issues of the National Intellectual Property Authority," dated October 28, 2022, No. 943. The document defines the State Organization "Ukrainian National Office for Intellectual Property and Innovations" (UANIPIO) as the entity that performs the functions of the National IP Authority from November 8, 2022, and terminates their performance by the State Enterprise "Ukrainian Intellectual Property Institute" (UIPI). This is a logical step foreseen by the legislation and long-awaited by the professional community on the way to the implementation of the reform of the institutional component of the state intellectual property system, which Ukraine has been implementing since 2016.
