Code of Сonduct

As Members of the American Chamber of Commerce, the goal is to operate and conduct business in accordance with the law of the land and to accept certain guiding principles based on U.S. and Western business practices as a preferred code of conduct. Without attempting to draw up detailed guidelines to govern every situation that might arise in the course of diverse and complex business activity in Ukraine, the American Chamber of Commerce has established these basic principles only as general operating guidelines that all Members are expected to follow:

  • Members will make every effort to comply with the laws of Ukraine to which they are subject.
  • Members will avoid knowingly assisting any third party in violating any law of Ukraine.
  • Members will not knowingly pay or receive bribes or participate in any other unethical, fraudulent, or corrupt practice.
  • Members will endeavor to honor all business obligations and commitments that they undertake with professionalism and integrity.
  • Members will keep business records in a manner that properly reflects the true nature of their business transactions and activities.
  • Members will ensure that their management and supervisors are familiar with applicable labor laws and corporate policies and will take responsibility for preventing and detecting violations in the course of their business operations.
  • Members will not be engaged into any concerted competitive behaviour (action or inaction) with other business entities, such behaviour being qualified as anti-competitive concerted actions under Ukrainian law, unless such behaviour has been duly approved by the Antimonopoly Committee of Ukraine or other competent state body in advance, as the case may be.
  • Members will not directly or indirectly offer, pay, receive or authorise any third parties to offer, pay or receive without justification advantages of any kind (bribes) or participate in any other unethical, fraudulent, or corrupt practices. 

The principles outlined here are not intended to preclude business or professional relationships that are recognized as both legal and acceptable under applicable law and custom, and that would not cause embarrassment to any party involved, if publicly known.

U.S. Express Business Visa

U.S. Express Business Visa

Another exclusive benefit you can enjoy being a part of the wide Chamber family! The Chamber facilitates the process of scheduling the appointment for direct employees of Chamber Member Companies at the Consular Section of the U.S. Embassy and provides a letter of support for single entry visa. The Chamber’s U.S. Express Business Visa service is only available to direct employees of Chamber Member Companies in Good Standing.

IMPORTANT NOTICE:

Dear applicants, please note that there is no facility at the Embassy to store prohibited items. In the past, applicants were allowed to check and store certain small items including cell phones with Embassy security staff. As of February 1, 2016, this will no longer be allowed, and you must make arrangements to store these items before entering.

Starting November 1, 2016, eye glasses will no longer be allowed in visa photos. For further details on photo requirements please visit: https://travel.state.gov/content/travel/en/us-visas/visa-information-resources/photos.html​.

Please note that TMM Express will only hold passports for 15 calendar days from the date that you receive confirmation that your passport has arrived at the pickup location. You will be notified by email that your passport is ready for pickup. You will receive three email messages and one phone call. If it is not picked up before the 16th day, your passport will be returned to the Embassy in Kyiv. It will then be your responsibility to make private arrangements to have the passport delivered to you at your expense. Once you have made these arrangements, please ask the courier company to contact the Embassy to coordinate pick up.

This service is offered to the following individuals:

  • ONLY to the direct employees of Chamber Member companies
  • Those direct employees who have never had a U.S. visa rejection in the past
  • Those direct employees who travel for legitimate business purpose

The Chamber will be unable to process family members at any time for any reason in accordance with the Chamber’s agreement with the US Embassy regarding the US Express Business Visa service.

Please note that the Chamber does not guarantee that applicant will receive a visa, nor we can influence the decision of the Embassy. The Embassy does not provide any explanations to the Chamber about visa refusals.

Interested parties should contact us as early as possible, as we can send a limited number of applicants each Monday to the U.S. Embassy Consular Section. The written request to the Chamber should be done well in advance of the travel dates as poorly planned business trips are not considered an emergency and cannot be rushed.

Please NOTE!!! If the applicant does not cancel the reservation in advance (before the list of Chamber applicants is submitted to the Embassy) and is not present at the interview at the appointed time, he/she will not have an opportunity to use US Express Business Visa service in the future.

To take advantage of the Chamber U.S. Express Business Visa service a Member Company should submit the documents to the Chamber by 5PM on Monday (prior to the desired appointment date). The Chamber schedules appointments for 2:30 PM every Monday (except for official holidays)

NECESSARY DOCUMENTS:

  1. DS-160 confirmation number
  2. Visa fee payment receipt
  3. The original of Request Form for U.S. Express Business Visa Service of the Chamber [DOWNLOAD THE FORM]
    Please note that the form should be signed by the COI* of the Chamber Member Company)
  4. A copy of the first page of the applicant's international passport.
  5. A copy of official Letter of Invitation from an organization in the United States
  6. The original of employment certificate (provided by HR or Accounting department)
  7. The original of Personal Data Usage and Transfer Consent signed by the applicant [DOWNLOAD THE CONSENT]

The applicant will then receive a letter from the Chamber that must be picked up on Friday prior to the appointment date and presented to the U.S. Embassy Consular Section upon arrival, in addition to OTHER NECESSARY DOCUMENTS TO THE INTERVIEW requested by the U.S. Embassy:

  1. An international passport, valid for at least 6 months after the anticipated departure from the USA.
     
  2. A completed copy of each application forms necessary for the type of visa which the applicant will be requesting.
    DS-160: Web-based Nonimmigrant Visa Application: the form must be filled out online, correctly, without mistakes, and submitted at least 2 days prior to the appointment date. Note that the photograph that the applicant shall be asked to upload before submitting the form must be of a good quality and meet all the requirements. In case you have failed to upload a photo while filling out DS-160, you must bring one to the interview. NOTE: Any inquiries on completing the DS-160 will be addressed on the following website: https://travel.state.gov/content/travel/en/us-visas/visa-information-resources/forms/ds-160-online-nonimmigrant-visa-application/ds-160-faqs.html. We are unable to answer any questions or provide guidance on this process. 

    NOTE: Uploading the photo is highly recommended. The photo must meet following requirements:
    • A 5 x 5cm color photograph taken within the last 6 months, for each applicant regardless of age.
    • The photograph must be, taken against a white background, with applicant facing the camera directly, having a neutral facial expression, ears are exposed, no dark glasses nor head covering (unless the applicant's religion prohibits the absence of a head covering).
    • The face should cover 50 percent of the area of the photo.

  3. Visit http://www.ustraveldocs.com/ua, select your visa type, and print out the deposit slip for the visa application fee amount (fee differs based on visa type).
  4. Pay the application (MRV) fee at a Raiffeisen Bank branch in Ukraine.
  • Applicants must bring a deposit slip for their visa class in order to pay at the bank.
  • Payment must be made in cash and only in Ukrainian Hryvnia.

All applicants are subject to the same processes and qualifying factors.

As a part of the visa application process, U.S. Consular Officers must take scans of all fingers of all visa applicants. Officers take the scans at the time of the interview. The electronic scanning procedure takes only a few seconds and does not use ink. Click here for more information about it.

NOTE:

Certain nonimmigrant visa applicants who were issued a previous U.S. visa do not need to schedule an interview at the Consular Section and may use  the Renewal Procedure by Mail. You are eligible for the Renewal Procedure if you meet ALL the following requirements:

  • resides in Ukraine and is not from a country which is a state sponsor of terrorism;
  • is renewing a B1/B2, C1/D, F, I or M visa that expired no more than 12 months ago;
  • is not ineligible to receive a visa under U.S. visa law;
  • has never been refused a visa - or if refused, the refusal has been overcome.
