Sayenko Kharenko’s counsel in the Task Force working on the translation of the IBA Guidelines Party Representation in International Arbitration

Olena Perepelynska, counselat Sayenko Kharenko, acted as a member of the Task Force working on the translation into Ukrainian of the IBA Guidelines Party Representation in International Arbitration (the “Guidelines”), adopted by IBA Council Resolution on 25 May 2013.

Despite the popularity of international arbitration, until recently, there had been no regulations for the conduct of the representatives of the parties to international arbitration. Due to this fact, the parties’ representatives were guided by their respective national rules. However, national rules of professional ethics vary substantially, which complicated the process at both the national and international levels.

The IBA Guidelines clarify controversial issues regarding the representation of parties.

The IBA Guidelines on Party Representation in International Arbitration are inspired by the principle that party representatives should act with integrity and honesty and should not engage in activities designed to produce unnecessary delay or expense, including tactics aimed at obstructing the arbitration proceedings.

The Guidelines are not intended to limit the flexibility that is inherent in, and a considerable advantage of, international arbitration, and parties and arbitral tribunals may adapt them to the particular circumstances of each arbitration.

The Task Force on the translation of the Guidelines into Ukrainianincluded also Ihor Siusel and Kseniia Pogruzhalska (both from Baker & McKenzie CIS).

Olena Perepelynska has been recommended among leading arbitration practitioners in Ukraine by The International Who’s Who of Commercial Arbitration 2013Ukrainian Law Firms 2014 and Best Lawyers International 2014; and among leading dispute resolution practitioners in Ukraine by Chambers Global 2014 and Chambers Europe 2014.
