Knowledge Seminar on Beneficial Ownership Concept for MRDU and Ministry of Finance of Ukraine

Natalia Rudenko, Deloitte, and Roustam Vakhitov, Baker Tilly Ukraine, mainly focused on theory fundamentals, existing practice and representative court cases.

When discussing problematics, the speakers, among other things, recommended Ministry's officials treating the BO concept in a broader sense, following the internationally recognised substance over form approach instead of common practice of Ukrainian courts favouring literal interpretation.

Seminar participants also discussed the issues of using conduit companies for royalty purposes, factor of business purpose in repatriating dividend and interest payments etc.
