After several years of intense debates on June 1st, 2007 the new extensive EU Regulation on Registration, Evaluation and Authorization of Chemicals (REACH) has entered into force. It constitutes one the most complex and comprehensive pieces of legislation the EU has ever introduced, changing dramatically the way chemicals are regulated in Europe. Obviously, this poses challenges both for chemicals manufacturers and importers, as REACH shifts the burden of proof from the authorities to businesses. REACH requires industry to register all existing and future new substances with a new European Chemicals Agency (ECHA). The ECHA opened in Helsinki on the same day as the REACH entered into force.

What is REACH?
The central act of the new European chemicals policy is Regulation (EC) No 1907/2006. It is often referred to as the "REACH Regulation".

REACH Seminar and Practical REACH Workshop
The Chamber was pleased to partner with the European Bank for Reconstruction and Development (EBRD) that hosted two important REACH events in Kyiv in September 2008. REACH is an entirely new piece of legislation implemented by the European Union and requires action by Ukrainian companies doing business in the EU by November 30th, 2008.
The Chamber is committed to ensuring that Ukraine's economy continues to grow and develop competitively and that information that is required for companies to comply with REACH is provided in a timely fashion helping Ukraine to successfully move further down the path of integration into the larger global marketplace.
The Seminar on September 22nd gave a high level overview of the legislation for all Ukrainian business leaders and regulators. The Workshop on the following day, September 23rd provided practical tools, information and advice for people from business who will be responsible for implementing the REACH registration.

REACH Working Group of the Chamber

The American Chamber of Commerce in Ukraine ("Chamber") and our sister organization the American Chamber of Commerce European Union ("AmCham EU") have been involved in the REACH initiative providing input into the process as well as informing our Membership and partners about the practical implications of REACH as it is one the most complex and comprehensive pieces of legislation the EU has ever introduced, changing dramatically the way chemicals are regulated in Europe. These new regulations pose challenges both for chemicals manufacturers and importers, as REACH shifts the burden of proof to businesses. REACH requires industry to register all existing and future new substances with a new European Chemicals Agency (ECHA). The ECHA opened in Helsinki on the same day as REACH entered into force.
Unfortunately, among the main market players and those who will be impacted by the new rules and requirements, little is known about REACH in Ukraine. The current situation requires all companies exporting certain products to have pre-registered them by November 30th, 2008 with the European Chemicals Agency in Finland. Taking action today means ensuring a competitive advantage for Ukrainian business tomorrow. Failure to properly register is likely to mean that exports of chemicals and products that incorporate chemicals will be seriously curtailed.
Due to the importance of this legislation for the business climate and in protecting the Chamber's Policy Team is assembling a special REACH Working Group.
We would like to invite all Chamber Members who are interested in all aspects of Regulation on Registration, Evaluation and Authorization of Chemicals (REACH) and its impact upon the domestic and European business to take part in the special REACH Working Group under the Chamber.

The Chamber Policy Team will be responsible for taking the recommendations and amendments to national legislation developed by the Working Group as well as organizing special events dedicated to REACH and meetings with relevant state authorities.
