J-E-T-S Chant Contest
Official Rules
No Purchase Necessary to Enter or Win. A Purchase will Not Increase Your Chances of Winning. Many will enter, one will win.
1) Eligibility:
The J-E-T-S Chant Contest (“Contest”) is open to 2014 New York Jets Season Ticket Holders (“STH”), who are legal residents of the fifty (50) United States & the District of Columbia (excluding residents of Colorado and Maryland) & 18 years of age or older as of the date of entry (“Entrants”). Professional singers, with professionals being defined as someone who has earned income singing in the last three (3) years, and the employees, officers, directors, agents and representatives of New York Jets LLC (“Sponsor”), the National Football League, its member professional football clubs, NFL Ventures, L.P., and each of their respective parents, affiliates, subsidiaries, wholesalers, retailers, distributors, suppliers, advertising and promotion agencies (hereafter collectively, “Released Parties”), and each such individual’s immediate family members (mother, father, sister, brother, daughter, son, child, husband, wife and their respective spouses, regardless of where they reside) and those living in their same households, whether or not related, are not eligible to participate or win. Entrants must not be represented by an agent or manager and must not be subject to any guild, union or other organization or agreement that would restrict or prohibit participation in this Contest. Void in Colorado and Maryland and where prohibited by law. All applicable federal, state and local laws apply.
2) Promotion Period:
Contest begins 12:00:00 pm (noon) Eastern Time (“ET”) on 8/11/14 and ends 11:59:59 am ET on 8/25/14 (hereafter, “Promotion Period”).
3) How to Participate:
Visit Jets Chant Leader Submission during the Promotion Period. Then follow the instructions provided to complete/submit the registration form including your first and last name, phone number, email address, STH account number, your typed response telling us why you or a person of your choosing (“Nominee”) is the best J-E-T-S Chanter, and a video no longer than fifteen (15) seconds in length of you or your Nominee displaying their best J-E-T-S Chant (“Video”). Nominee must be 18 years of age or older. Your typed response to the question must be no more than one hundred (100) characters or less (“Essay”). Video must be in .mpeg, .mov, .wmv, .avi, .mp4 or .flv format and 10MB or less in size. Videos longer than fifteen (15) seconds in length will not be reviewed and deemed void. Your Essay and your Video will be judged, as provided hereunder. Video and Essay shall be collectively referred to hereafter as the “Entry". To be eligible, all Entries must be received by 11:59:59 am ET on 8/25/14.
Video must be (i) an original, on which no image editing software has been used (except for as otherwise outlined in section 4 below); (ii) saved in one of the file formats and within the size limitations outlined above; and (iii) recorded by you or your Nominee. Modification of an existing work does not qualify as original. Only one (1) Entry per person and per e-mail address will be accepted for the duration of the Promotion Period. Additional Entries received from any person or e-mail address in excess of the stated limitation will be void. To be eligible, Entry cannot have been previously submitted in any competition or have won any previous awards, and must be (i) complete, (ii) in English (including background signs, posters, etc.), (iii) your original recording of the chant and solely owned by you. In addition, to be eligible, Entry must not include (i) any music that is pre-recorded or played by a band, (ii) any background tracks or instruments, (iii) any other person other than yourself or your Nominee, or (iv) any unauthorized third party logos, names or slogans other than NY Jets Team name, slogan or logos (collectively, the “Permitted Marks”) as specifically permitted hereunder. Entry cannot defame, or invade publicity and/or privacy of any person, living or deceased, or otherwise infringe upon any person’s personal or property rights or any other third party rights. Entry may also not contain, as determined by Sponsor in its sole discretion, any other singers, musical samples, any content that is sexually explicit or suggestive; violent or derogatory of any ethnic, racial, gender, religious, professional or age group, profane or pornographic; contains nudity; promotes alcohol, illegal drugs, tobacco, firearms/weapons (or use of any of the foregoing); promotes any activities that may appear unsafe or dangerous; promotes any particular political agenda or message; is obscene, offensive, or inappropriate; misrepresents or contains disparaging remarks about any persons or companies; contains any personal identification (other than as provided on the registration form) such as personal addresses, etc.; contains copyrighted materials owned by others (including photographs or images published on or in websites, television, movies or other media) without permission; contains materials embodying the names, likenesses, voices, or other indicia identifying any person, including, without limitation, celebrities and/or other public or private figures, without permission; contains look-alikes of celebrities or other public or private figures, living or dead; communicates messages or images inconsistent with the positive images and/or good will to which Sponsor wishes to associate; and/or violates any law. Entries deemed by the judges, in their sole discretion, to be immoral, obscene, profane or not in keeping with Sponsor’s image or in violation of these Official Rules will be void. In the event of non-compliance with any requirements specified herein or with any of the terms of these Official Rules, Entry will be void.
If Entry contains any third party logos, names or slogans which are subject to the rights of third parties (excluding the Permitted Marks), the entrant is responsible for obtaining, prior to submission of the Entry, any and all releases and consents necessary to permit the use and exhibition of the Entry by Sponsor in the manner set forth in these Official Rules, including, without limitation, name and likeness permissions from any person who is identifiable in the Entry (and, if such person is a minor, permission from that person’s parent or legal guardian). Sponsor reserves the right to request proof of these permissions in a form acceptable to Sponsor from any entrant at any time. Failure to provide such proof may, in Sponsor’s sole discretion, render Entry null and void. By submitting an Entry, entrant warrants and represents that he/she and any person(s) who are identifiable in the Entry consent to the submission and use of the Entry in this Contest and to its use as otherwise set forth herein.
Sponsor grants to entrants and their Nominee (as applicable) a limited revocable, non-sublicensable, license to use Permitted Marks for the sole purpose of creating an Entry and entrant may make no further use whatsoever of Permitted Marks or the Entry for any other purpose. In addition, entrant recognizes all of the right, title, and interest in the Permitted Marks as well as all derivative works created using the Permitted Marks (including the Entry) shall vest exclusively with Sponsor, and entrant will not have or take any action that might harm or adversely affect such rights. No right, title, or interest in and to Permitted Marks except for the limited license granted to entrant in these Official Rules is transferred or created. By submitting an Entry (as described below), each entrant and their Nominee (as applicable) agrees Sponsor shall own the Entry submitted (including the copyright thereto and all rights embodied therein) and that it and its designees may exploit, edit, modify, and distribute the Entry and all elements of such Entry, in any and all media now known or hereafter devised, worldwide, in perpetuity without compensation, permission or notification to entrant or any third party.
By submitting an Entry, entrant and their Nominee (as applicable) hereby grants Sponsor, without any limitation of any other rights granted herein, permission for the Entry to be posted on a the Jets website and/or other websites or in any media, as determined by Sponsor in its sole discretion, for advertising, trade, promotional, and/or any other purposes. Entrant agrees that Released Parties are not responsible for any unauthorized use of Entries by third parties. Released Parties do not guarantee the posting of any Entry.
By submitting an Entry, entrant acknowledges and agrees that Sponsor may obtain many Entries in connection with this Contest and/or other contests staged and/or promoted by the Sponsor, and that such Entries may be similar or identical in sound, format or other respects to other Entries submitted in connection with this Contest and/or other contests sponsored by the Sponsor or submitted for other reasons or other materials developed by the Sponsor. Entrant waives any and all claims entrant may have had, may have, and/or may have in the future, that any Entry and/or other works accepted, reviewed and/or used by the entrant may be similar to his/her Entry, or that any compensation is due to entrant in connection with such Entry or other works used by Sponsor.
In the event of a dispute as to the identity of an Entrant, such Entrant will be deemed the individual named on the Entry and named on the 2014 STH Account (“Account”), as determined by Sponsor, regardless of whether that individual is the authorized account holder and/or individual who funds the Account at issue provided that person meets all eligibility criteria set forth in these Official Rules.
4) Judging:
Round 1: All eligible Entries received will be judged by a panel of qualified judges based on the following criteria by Sponsor: 1) Level of Emotion: 0-20 points; 2) Quality of Performance and Presence: 0-20 points; 3) Quality of Voice and Projection: 0-30 points; and 4) Ability of Entry to Demonstrate Jets Fandom: 0-30 points (collectively, the “Judging Criteria”).
The twenty (20) Entries with the highest scores as determined in Round 1 by the judges in their sole discretion, will be determined potential “Finalists” and will advance to Voting. Sponsor reserves the right to advance fewer than twenty (20) Finalists if, in their sole discretion, they do not receive a sufficient number of eligible and qualified Entries.
In the event of a tie during Round 1 of judging, such tied Entries will be re-judged based on: Ability of Entry to Demonstrate Jets Fandom: 0-100 points. By participating, entrants agree to abide by these Official Rules and the decisions of the Sponsor and judges, which are final and binding in all matters relating to this Contest.
5) Voting:
Upon verification of eligibility and compliance with these Official Rules, each Finalist’s Entry will be posted on a newyorkjets.com/jetschant to be voted on by the public. The Voting Period will begin 12:00:00 pm Eastern Time (“ET”) on 8/26/14 and end 11:59:59 am ET on 8/29/14. Voting is open only to legal residents of the fifty (50) United States and the District of Columbia, 18 years of age or older (hereafter, “Voters”). To vote for the Finalist whose Entry you think demonstrates the most Jets Fandom, follow the prompts to view each Entry and cast your vote.
At the conclusion of the Voting Period, the highest ranked eight (8) Entries will be determined the Grand Prize winners, subject to verification of eligibility and compliance with these Official Rules. In the event of a tie during the Voting Period, such tied Entries will be re-judged (by a panel of judges determined by Sponsor in its sole discretion) based solely on the Entries ability to demonstrate Jets Pride: 0-100 points.
The use of script, macro or automated or mechanical devices (or any other devices intended to automate or subvert any aspect of participation, entry or voting) to participate, enter or cast a vote is prohibited and any Entry or vote through such means will, at Sponsor’s sole discretion, be void. Finalists are prohibited from obtaining votes by any fraudulent or inappropriate means, including, without limitation, offering prizes or other inducements to members of the public, as determined by Sponsor in its sole discretion. Other than as otherwise specified herein, neither Sponsor, nor anyone acting on its behalf, will enter into any communications with any entrant regarding this Contest (except for the purposes of notifying the winners) or acknowledge any Entry or Vote (or portion thereof) received. Any Entry not meeting all Entry requirements stated herein will be void.
Incomplete Entries and/or Entries containing inaccurate entrant information will be disqualified at Sponsor’s sole discretion. All Entries submitted become the exclusive property of the Sponsor and will not be acknowledged or returned. Released Parties are not responsible for late, lost, stolen, damaged, incomplete, misdirected, delayed, garbled, inaccurate, or undelivered Videos, Essays, Entries, Votes, mail or emails or for telephonic, human or computer failures, problems or errors, interruptions in service due to system upgrades, repairs, modifications or other causes, failures or malfunctions of connections, satellite, network, server, cable, Internet Service Provider (ISP), phones, phone lines or telephone systems, traffic congestion on the internet, technical or mechanical malfunctions, or other malfunctions or errors, whether caused by equipment, programming, human error or otherwise relating to or in connection with the Contest, including, without limitation, errors which may occur in connection with the administration of the Contest, the processing of Videos, Essays, Entries, or Votes, or the judging of Entries, or the announcement of the prizes, or for any injury or damage to participant’s or any other person’s computer relating to or resulting from participation in this Contest, or downloading materials from or use of the website, or for printing, typographical, mechanical, electronic, network, human or other errors appearing in these Official Rules or other Contest-related materials. Sponsor reserves the right, in its sole discretion, to void any Entries of participants whom Sponsor believes has attempted to tamper with or impair the administration, security, fairness or proper play of this Contest or is in violation of these Official Rules.
6) Prizes:
Eight (8) Grand Prizes:The opportunity for the STH or Nominee to be the designated J-E-T-S Chanter at a 2014 Jets regular season home game designated by Sponsor and a Jets cap. Approximate Retail Value (“ARV”) of each Grand Prize = $30. Winner and guest (if applicable) will be responsible for any/all transportation to/from the designated game. Grand Prizes will be awarded in the name of the winning STH, regardless if Nominee was depicted in the winning Entry. If Nominee is selected as a Grand Prize winner, STH must accompany his/her respective Nominee to the game as their guest, and Nominee will be deemed the designated chanter. If Nominee is selected as a Grand Prize winner and STH only has one (1) ticket for the designated game, STH will forfeit their ticket to the Nominee for game attendance. Exact seat locations will be the seats currently held by the STH. All prize details are at Sponsor’s sole discretion. In the event the designated game is postponed and rescheduled, prize will be rescheduled around the date of the rescheduled game. In the event the game is postponed and not rescheduled or otherwise cancelled, no compensation or substitution for chant portion of the prize will be provided; however, the remainder of prize package will be awarded and Sponsor will have no further obligation to winner. Winner and/or Nominee must attend the game specified by Sponsor or prize will be forfeited in its entirety and, at Sponsor’s discretion and time permitting, may be awarded to a runner-up. All costs and expenses associated with the acceptance and use of the prize not specified herein as being awarded, including, but not limited to, any/all transportation to game, parking pass, all federal, state and local taxes, food, beverages, souvenirs, gratuities, and other miscellaneous travel expenses are winner’s sole responsibility. Tickets are subject to terms and conditions specified thereon. Winner and guest (if applicable) agree to comply with all game and venue rules and regulations and, in accordance therewith, agree not to act in an unsportsmanlike or disruptive manner, or with any intent to annoy, abuse, threaten or harass any other person at the designated game. Winner and guest (if applicable) will be escorted out of venue by Sponsor or its designated agent(s) for improper conduct and/or violation of federal, state or local laws (including, but not limited to, the unlawful possession, use, or distribution of illicit drugs, unlawful drug paraphernalia, and alcohol), as Sponsor determines in its sole discretion, and will forfeit the balance of his/her prize. Other than the details of the Grand Prize outlined above, Released Parties have no additional obligations or commitments to the Grand Prize winners in connection with this Sweepstakes.
7) Miscellaneous:
No transfer, assignment, cash redemption, or substitution of prize (or portion thereof) is permitted except by Sponsor, who reserves the right to substitute the prize (or applicable portion thereof) with one of comparable or greater value, at its sole discretion and except as otherwise provided herein. Winning STH and their guest must execute and return a Liability and (where legal) Publicity Release. At time of winner selection/notification, STH must be a 2014 Jets season ticket holder who is in good standing per the Jets season ticket guidelines. By participating, Entrants agree to abide by these Official Rules and the decisions of the Sponsor, which shall be final and binding. Entrants agree, by entering, that 1) Sponsor and its designees may use (unless prohibited by law), Entrant’s name, city and state of residence, Entry (and all material embodied therein), any written content, photographs, any recordings (voice, video or film) and/or other likeness for advertising, trade and/or any other purposes in any media now or hereafter known throughout the world, in perpetuity, without further compensation, permission or notification, and 2) the Released Parties shall have no liability and will be held harmless by Entrant for any claim, action, liability, loss, injury or damages of any kind, including death, to persons, or property due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of a prize and any activity or travel related thereto (including, but not limited to, any travel/activity related thereto or attendance at the game), participation in this Contest or use of any Entry. Entrants warrant and represent that (1) Sponsor and its designees shall own the Entry (and all elements embodied therein); (2) by entering, the entrant irrevocably assigns to Sponsor and its designees any and all rights, title and interest in the Entry including, but not limited to, all intellectual property rights; and (3) Sponsor and its designees shall have, without limitation, the perpetual worldwide right to edit, adapt, modify, publish, reproduce, exploit and use the Entry in any way and in any media for trade, advertising, promotional and/or other purposes as Sponsor and/or its designees may determine without further consideration, notification or permission of Entrants. Sponsor reserves the right, in its sole discretion, to modify, suspend, and/or terminate this Contest (or portion thereof) for any reason, including but not limited to, should virus, worms, bugs, non-authorized human intervention or other causes, including, but not limited to, acts or threats of terrorism, war, strikes, and/or acts of God, corrupt or impair the administration, security, fairness or proper play of the Contest and, in the case of termination, at its discretion, select winners from all eligible non-suspect Entries received prior to the event requiring such termination using the judging procedure outlined above. CAUTION: Any attempt to deliberately damage the website or undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek any and all remedies available from any such person(s) responsible for the attempt to the fullest extent permitted by law.
8)Arbitration:
Except where prohibited by law, as a condition of participating in this Contest, participant agrees that (1) any and all disputes and causes of action arising out of or connected with this Contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the participant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than participant's actual out-of-pocket expenses (i.e., costs associated with participating in this Contest), and participant further waives all rights to have damages multiplied or increased.
9) Choice of Law:
All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the substantive laws of the State of New York, USA.
10)Winner's Names:
For the names of the winners (available after 9/22/14), send a self-addressed, stamped envelope to be received by 9/22/14 to J-E-T-S Chant Contest Winners, C/O New York Jets, 1 Jets Drive, Florham Park, NJ 07932.
