Verkhovna Rada Supported Chamber Amendments to Article 82 of the Land Code of Ukraine
The Draft Law #11128 “On Amendments to the Land Code of Ukraine regarding Acquisition of Land Ownership Rights” which amends Article 82 of the Land Code of Ukraine by removing excessive obstacles for legal entities with foreign capital to own non-agricultural land was passed in the first reading by the Verkhovna Rada of Ukraine.

Parliament Passed Two Progressive Draft Laws on Improving PSA Execution
The Draft Laws of Ukraine #11120 “On Amendments to the Tax Code of Ukraine regarding Product Sharing Agreements Conclusion and Execution” and #11213 “On Amendments to Certain Legislative Acts of Ukraine regarding Product Sharing Agreements Execution” were passed by the Verkhovna Rada of Ukraine in the first reading which the American Chamber of Commerce in Ukraine (Chamber) strongly supports.
The Chamber welcomes the intention of the state aimed at holding transparent competitive tenders for the PSA execution, and believes that adoption of the mentioned Draft Laws is an integral part of the successful and efficient implementation of the PSA mechanism.

Supreme Administrative Court of Ukraine Issued a Letter Aimed at Protecting Taxpayers in Judicial Cases on Tax Loss Carry Forward
Тhe Supreme Administrative Court issued the letter to local courts and administrative courts of appeal with regard to issues related to the application of several positions of the Tax Code of Ukraine.
The Chamber believes that the clarification provided by the Supreme Administrative Court will help to discontinue all court cases stemming from the issue on tax loss carry forward and will continue its lobbying activities in order to make sure that court cases relating to the Chamber Member Companies are stopped, as well as establish clear and favorable rules for doing business in Ukraine.

Investors Signed the Annex to the Memorandum of Understanding with the Ministry of Agricultural Policy and Food

President Signed the Law on Land Auctions
Тhe President of Ukraine signed the Law #5077-VI “On Amendments to the Land Code (On Holding Land Auctions)” which establishes a legislative mechanism for selling and purchasing land plots by holding tenders with the purpose of forming a complete regulatory framework for carrying out land auctions in Ukraine.
