Review of Events

As we informed our readers earlier, the XV International Scientific and Practical Conference “Actual Problems of Intellectual Property”, organised by the State Department of Intellectual Property jointly with the World Intellectual Property Organisation and the European Patent Office, took place in Svaliava last week.

The focus of the Conference was not only on the analysis of problems but also on the ways of their solution, which aroused keen professional interest of the participants. The representatives of different countries attending the event expressed their own vision of the matters of legal protection of intellectual property rights, shared their practical experience, learned a great deal from their colleagues and took part in heated debates.

At the opening ceremony, Volodymyr Dmytryshyn, the Deputy Chairman of the State Department, outlined the main milestones of the development strategy for the state system of the legal protection of intellectual property.

- This is already the fifteenth traditional meeting dedicated to the topical issues existing in this field, - he reminded the audience. – I am convinced that there is no need to emphasise the importance of the development and improvement of the national system of the legal protection of intellectual property for every country. However, today we still face a number of problematic issues and, in order to overcome these problems, specialists of the intellectual property domain have to join their efforts.

- To date, one of the most important directions of the state policy in Ukraine is fostering the development and efficient use of achievements of creative minds – scientists, inventors, authors, performers – people capable of generating new ideas, manufacturing competitive products, enriching the nation’s spirituality and culture, - underlined Volodymyr Dmytryshyn.
The Conference work was organised in panels.

At the first panel, Oksana Parkheta, Head of a SDIP’s Section, Petro Ivanenko, Deputy Director of the SE “Ukrainian Industrial Property Institute” (further – Institute) and other participants of the meeting considered the issue of intellectual property information support and economy. Representatives of foreign patent offices also took part in the discussion of this topic. In particular, Almagul Ashenova, Head of Information Support Service of the National Institute of Intellectual Property of the Republic of Kazakhstan, gave a recount of the process of informatisation of her Patent Office during the Conference, and, after the Conference had finished, went on to immediately study the work of the Patent Office of Ukraine in Kyiv.

  

  

In Ukraine, great significance is attached to the issues of intellectual property rights enforcement by administrative and judicial procedure. At the panel dedicated to the relevant topic this was accounted by Inna Shatova, Head of a SDIP’s Section, and Lev Glukhivskiy, First Deputy Director of the Institute. Representatives of legal firms participating in the Conference greatly contributed to the discussion of the current problems of the practice of dispute resolution concerning intellectual property rights violation and accentuated the need to join efforts to resolve the problems.

One of the most discussed topics presented at the Conference was the one concerning legal protection of industrial property rights (IPRs). During the meeting of the next panels, special attention was paid to inventions and designations. The relevant panels were chaired by the heads of the Institute’s corresponding divisions – Nataliya Petrova and Vasyl Bannikov. Besides domestic specialists, the representatives of the Patent Offices of the Republic of Moldova and the Republic of Kazakhstan actively participated in the discussion of the topic, reporting on the processes of the legal protection, use and enforcement of IPRs in their countries.

As a part of the XV International Scientific and Practical Conference “Actual Problems of Intellectual Property”, an Interregional Seminar on the matters of protection of audiovisual works and performances was held. The necessity and urgency of such event are determined by the need to solve a number of problems that have accumulated in the field of audiovisual works protection. The seminar gathered a great number of domestic and foreign specialists, in particular, Michal Svantner, Director of WIPO’s Division of Cooperation with Certain Countries in Europe and Asia, Sergiy Semenov, Regional Representative of the International Federation of Film Producers Associations (FIAPF), Andy Prodger, Assistant General Secretary of the UK Trade Union representing professional performers, Jose Maria Montez, Director of the Legal and International Relations Department of the Organisation of Collective Management of Performers’ Rights (AISGE); Helmut Koszuszeck, Legal and Business Director of the Association of International Collective Management of Audiovisual Works (AGICOA) and others. The seminar was moderated by Tamara Davydenko, Head of the SDIP’s Copyright and Related Rights Division, who elucidated the matter of legal regulation of the processes of creation and use of audiovisual works and performances and the system of collective management of rights in this sphere in Ukraine.

Over 150 representatives of the intellectual property field from international and foreign organisations as well as specialists of the state system of the legal protection of intellectual property of Ukraine took part in the Conference.
