On December 10, 2003
Under the chairmanship of Serhiy KIVALOV the 50th session of the High Council of Justice (HCJ) took place. During the session the decision was made about forwarding the submission to the President of Ukraine on appointment of 62 candidates for the positions of judges in local general, local commercial courts, and courts of appeal.
The HCJ refused to forward the submission on appointment of 9 candidates for judges’ positions because of lack of their professional knowledge. Also the HCJ will pass in the submission to the President of Ukraine and to the Parliament of Ukraine on dismissal of 4 judges on the grounds of retirement.
At the end of the session the decision was made about rewarding judges with Honorary Awards of the High Council of Justice for long-term and assiduous work as well as for important contribution in law making.
After the session the Chairman of the High Council of Justice S. Kivalov answered the questions of the press. He admitted, “the Council would proceed to support and encourage the judges, who conscientiously fulfilled their functions while making the law. At the same time the Council would be merciless to those who would violate human rights or make misdeeds, which defame the status of judges as well as undermine the justice prestige in the country. ”The HCJ considered the complaints of judges on decisions made by the corresponding Judge Qualification Commissions. Two complaints were satisfied and the decision to impose a disciplinary penalty was cancelled.

Under the chairmanship of Serhiy KIVALOV the 49th session of the High Council of Justice (HCJ) took place. During the session the decision was made about forwarding the submission to the President of Ukraine on appointment of 63 candidates for the positions of judges in local general, local commercial courts, and courts of appeal.
The HCJ refused to forward the submission on appointment of two candidates for judges’ positions because of lack of their professional knowledge. Also the HCJ will pass in the submission to the President of Ukraine and to the Parliament of Ukraine on dismissal of 23 judges on the grounds of retirement.
The HCJ considered the complaints of judges on decisions made by the corresponding Judge Qualification Commissions. One complaint was satisfied and the decision to impose a disciplinary penalty on Yuriy ZAKLAD, the judge of the Leninsky district court of Odesa, was cancelled. The complaint of Mykola DMYTRENKO, the judge of Sosnivsky district court of Cherkasy, was rejected and the decision of the Qualification Commission was not changed. The complaint of Vasyl MAZUR, the judge of Ordzhonikidzevsky district court of Zaporizhzhya, was satisfied partially. Instead of demotion, the judge was reprimanded.
The HCJ reserved the consideration of the question concerning the oath violation by three judges for the next session in order to conduct an additional examination of the cases materials. According to the primary information, these judges carelessly made decisions based on stale legislation. That caused objectionable result – tens of millions hryvnyas were not received by the state budget.
In the view of dismissal of the Prosecutor General of Ukraine Svyatoslav PISKUN, the HCJ made a decision to discontinue his ex officio membership in the HCJ.

On September 23 – 25, 2003
the delegation from the National Judiciary Council of the Republic of Poland visited Ukraine on an invitation from the High Council of Justice of Ukraine. The following officials were included to the delegation: the Vice-Chairman of the National Judiciary Council of the Republic of Poland Krzysztof STRZELCZYK, and members of the Council Ewa CHALUBINSKA and Marek CELEJ.
During the official meeting at the High Council of Justice of Ukraine, the HCJ Deputy Chairman Mykola SHELEST and the Secretary of Personnel Section of HCJ Yuriy POLTAVETS told the Polish delegation about the authorities, competence, principles of forming and structure of the HCJ, requirements for candidates for judge positions, the procedure of their appointment and dismissal. In response, the members of the Polish delegation informed the Ukrainian colleagues about the structure and activity of the National Judiciary Council of the Republic of Poland, which was established in 1989, its tasks and practice in forming of the judges corps. Parties also exchanged the information about the course of the judicial reforms in our countries, mentioned the weaknesses of the current legislation in the sphere of the judiciary councils functioning and judicial systems in general, discussed the directions of the further collaboration.
According to the visit schedule, the delegation also met the leaders of the Supreme and High Commercial Court of Ukraine, visited the Kyiv Appeal court and Brovary city court of Kyiv oblast. Parties shared their thoughts about the problems of justice, guarantees for independence of judges and courts, discussed the tendencies of judicial power development.

Under the chairmanship of Serhiy KIVALOV the 48th session of the High Council of Justice took place. During the session the decision was made to about forwarding the submissions to the President of Ukraine on appointment of 85 candidates for the positions of judges in local general, local economic courts and courts of appeal. Also the HCJ refused to pass in the submission concerning appointment of 15 candidates in view of the lack of professional knowledge appropriate to the judge position.
The HCJ allowed the complaint of the judge regarding the decision made by a corresponding qualification commission and reversed the mentioned decision. Also the HCJ will forward the submission to the Parliament of Ukraine on dismissal of 40 judges on the grounds of retirement and health condition.
Furthermore, the HCJ charged the HCJ Member, the judge of the High Commercial Court of Ukraine Valentyna PALIY with the duties of the Secretary of the Disciplinary section of the HCJ.

On On September 9 – 14, 2003
the delegation from the High Council of Justice of the Republic of Lebanon with its Head, the First President of the Court of Cassation Mr. Tanios KHOURY visited Ukraine on an invitation from the Chairman of the High Council of Justice of Ukraine Serhiy KIVALOV. The following Lebanese officials visited Ukraine: the President of the Judicial Inspection Tarek ZIADE, the Prosecutor General within the Court of Cassation, Vice-President of the High Council of Justice of the Republic of Lebanon Adnan ADOUM, and the Assistant of the Head of the High Council of Justice of the Republic of Lebanon Fransua KHOURY.
On September 10, 2003 Serhiy KIVALOV met with the Lebanese lawyers at the High Council of Justice of Ukraine (HCJ). The HCJ Deputy Chairman Mykola SHELEST, the HCJ Member, Secretary of the Section on Preparation of Submission for Initial Appointment of Judges and Their Release from Office Yuriy POLTAVETS, and heads of the HCJ departments took part in the meeting.
Serhiy KIVALOV told the Lebanese colleagues about the structure, tasks, activity and international connections of the HCJ. In response, Tanios KHOURY informed the Ukrainian lawyers about the directions and methods of work of the High Council of Justice of the Republic of Lebanon. Parties also shared the experience related to forming of the judges corps; told about the principles of selection, training and procedure of the appointment of candidates for the judge position and their dismissal; exchanged the opinions regarding the state and future trends of the judicial systems development; discussed the courts’ organisation and functioning, judges’ independence, professional ethics and responsibility and the directions of further collaboration between Ukrainian and Lebanese High Councils of Justice. Commenting the event, Serhiy KIVALOV noted the importance of this meeting to journalists: “We are greatly pleased that the Lebanese colleagues responded to our invitation to visit Ukraine, and we hope that the started co-operation between Ukraine and Republic of Lebanon in the legal sphere will be productive. This will help to orient ourselves in the activity of our colleagues in the Middle East and to use their experience and methods of work in our practice.”
According to the visit schedule, the Lebanese delegation visited the General Prosecutor’s Office, Supreme Court of Ukraine and the Institute of Professional Judges Training within the Odesa National Academy of Law. The delegation met future judges in the Institute, shared the experience regarding the legal proceedings in Lebanon. In the framework of the visit programme in Odesa, Lebanese lawyers met the Head of the Oblast State Administration Serhiy HRYNEVETSKY, Mayor of Odesa Roman BODELAN, the Chairman of the Odesa Commercial Court of Appeal Valeriy BALUKH, and the Chairman of the City Commercial Court of Odesa Valentyn PRODAYEVYCH.

On July 4, 2003
The state exams in the Institute of Professional Judges Training, which was created 1 year ago within the Odessa National Academy of Law, have finished. The first graduation will happen soon, and the graduates, after going through the procedure of appointment, will be able to occupy the vacant positions in courts of the general jurisdiction. Right now, more than twenty graduates, who have recommendations of the correspondent qualification commissions of judges, are on the halfway to their goal. After the exams had been finished, the Personnel Section of the HCJ conducted a session. During the session, interviews with the Institute's graduates – candidates for the judges' positions – were conducted. Majority of the candidates received the positive conclusions from the Section. After the session, the Secretary of Section Yuriy POLTAVETS answered the journalists' questions, and noted that this practice – visiting sessions of the HCJ Personnel Section – will continue to happen. This will allow to solve the issues regarding the selection of candidates for the judges' positions effectively, on places, also to save the state's costs, to find insufficiencies in the future judges' training and correct the educating process in Institute.
Seventy six trainees graduated from the Institute of Professional Judges Training within the Odessa National Academy of Law and obtained the Master's degree.

In the framework of conducting the "Year of Russia in Ukraine", heads of Ukrainian and Russian highest judicial bodies met in Odessa. This meeting took place by the initiative of the HCJ of Ukraine, and had the general title "The Role of the Judicial Power in the Mechanism of Protecting Human Rights". The problems of reforming the judicial-legal system in Ukraine and Russia, increasing the role of courts in protecting human rights in both countries, implementing the European standards in the national judicial systems were discussed during the meeting. Also the following issues were considered: the role of constitutional justice in protecting human rights and the importance of the HCJ activity in forming the judges' corpus.
The Presidents of both Ukraine and Russia sent their greeting remarks to the participants of the meeting. Leonid KUCHMA, in particular, expressed the confidence that "the results of the meeting will promote the international authority and influence of the judicial power on the process of forming the legal state and civil society. Volodymyr PUTIN considered this "meeting extremely useful for further development of the legal systems of our countries and reliable functioning of the judicial power – the highly important state institution, which guarantees human rights and liberties protection."
In result of the meeting, the Coordinating Council of Justice was established, which will have to organise mutual information exchange between both Sides and coordinate the activity in the sphere of justice in Ukraine and Russia and also the other countries of CIS (if they wish to join this project). The Protocol on Co-operation was sighed for 5 years and may be prolonged for another 5 years term, if the Sides do not decide to annul it. Organisational and financial support of the Council's activity will be provided by the Odessa National Academy of Law, which initiated and organised this first meeting of the heads of the Ukrainian and Russian judicial bodies. Serhiy KIVALOV, the Head of the HCJ of Ukraine, was elected unanimously as a Coordinator of the Council, and Marat BAGLAY, the Judge of the Constitutional Court of Russia, became a Co-coordinator from the Russian side. The Coordinating Council also includes: Valeriy ZORKIN, the Head of the Constitutional Court of Russia; Mykola SELIVON, the Head of the Constitutional Court of Ukraine, Vyacheslav LEBEDYEV, the Head of the Supreme Court of Russia, Vasyl MALYARENKO, the Head of the Supreme Court of Ukraine, Veniamin YAKOVLEV, the Head of the Supreme Arbitration Court of Russia, Dmytro PRYTYKA, the Head of the Highest Economic Court of Ukraine.

The Chairman of the HCJ Serhiy KIVALOV met the delegation from the High Council of Magistracy of Portugal Republic headed by this body's President, the Chairman of the Supreme Court of Portugal, Dr. Jorge Alberto Aragao SEIA.
The following officials also took part in the meeting: the Deputy President of the High Council of Magistracy of Portugal Republic, Dr. Luis Antonio Noronha NASCIMENTO, the Member of the High Council of Magistracy of Portugal, Judge, Dr. Jorge dos Santos, the Member of the High Council of Magistracy of Portugal, Dr. Luis Augustu Maximo dos Santos, Deputy Head of the HCJ of Ukraine Mykola SHELEST, Member of the High Council of Justice of Ukraine, Secretary of the Section on Submissions' Preparation for the First Appointment of Judges to Office and their Dismissal from Office Yuriy POLTAVETS, and the heads of the HCJ departments. During the meeting, Serhiy KIVALOV told the Portugal colleagues about the HCJ of Ukraine activity. The Sides exchanged the information regarding future development of the judicial systems in both countries, principles of selection, training and procedure of candidates' appointment on the positions of judges; discussed the issues of the further collaboration in the framework of the Protocol on Co-operation, which was signed on July 9, 2002 during the visit of the HCJ of Ukraine delegation to Lisbon.

The President of Ukraine L.Kuchma has awarded the state rewards to the group of members of the HCJ. This decoration made honourable mention of their personal remarkable contribution to implementation of governmental legal policy, strengthening of law and order and for their high professional level.
In his address to awarded members the Leader of state stressed upon that situation in judicial system is changing to better. "I am pleased to denote that the HCJ has become as a motive force of the positive changes. After adoption of the Law of Ukraine "On Judiciary" by the Verkhovna Rada, the role of the Council, as a constitutional body in formation of deserved portrait of our judicial system, will be increased,"- he said.
In his concluding remarks L. Kuchma, in particular, has dwelled on problems of constitutional reform in Ukraine. According to his words, this reform has entered a final phase. He stressed upon, that his recent meeting with the leaders of the parliamentary fractions has demonstrated that "we can find a compromise" on conducting the reform. The Leader of state also has appealed to the lawyers don't to be an outside spectators for process of constitutional reform in Ukraine and to enhance information activity on explanation of its legal aspects. "Everybody understand, that system of power set by the present Constitution, doesn't meet state goals", - stressed upon the President of Ukraine.
On the ceremony of decoration were present: Chairman of the High Council of Justice Serhiy Kivalov, Chairman of the Supreme Court of Ukraine Vasiliy Malyarenko, General Prosecutor of Ukraine Svyatoslav Piskun.
Decree "On reward of the members of HCJ with the state awards " was signed by the President of Ukraine on 29 March, 2003.

On June 11-12, 2003
There took place the 47th session of the High Council of Justice. The hard work was done before the session: within a month the personnel section has met for three times with the candidates to the position of judges with purpose of determination of knowledge level. According to the results of consideration of the Judge Qualification Commissions` recommendations, the Council took decision on forwarding submission to the President of Ukraine on appointment of 174 candidates to the positions of judges of local courts and economic courts. At the same time submissions of 34 candidates to judges` positions were rejected because of lack of their professional training.
Having considered the organizational question, the Council has elected the member of the HCJ, judge of the Supreme Court of Ukraine Mykola SHELEST onto the position of the Deputy Chairman of the High Council Justice. This decision was taken on the second day of the session after adoption of the third round of the elections, which were held on alternative base by the secret ballot.
The High Council of Justice also considered the claims of six judges on the decision of the corresponding Judge Qualification Commissions as to their call to disciplinary liability. One claim was satisfied and the decision of the Judge Qualification Commissions was canceled. The another two claims were left without satisfaction. The consideration of other claims was postponed to the next session in connection with the necessity of additional inspection of the circumstances, included in claims.
The Council also decided to submit the proposal to the President of Ukraine and to the Verkhovna Rada (the Parliament) on the dismissal of 21 judges from office on general ground, including the judge of the Supreme Court of Ukraine Vasyl ONOPENKO, who has submitted his application for retirement.

On May 28, 2003
the meeting of the Head of High Council of Justice, Serhiy KIVALOV, and the Judge of the European Court of Human Rights, Lucius Conrad CAFLISCH, took place in HCJ. Mr. CAFLISCH was invited to visit Ukraine by the HCJ and Odesa National Academy of Law, where he participated at the international conference "Judges of XXI Century" on May 30.
The Member of HCJ, Secretary of the section Yuriy POLTAVETS and the Ambassador of Switzerland Jean-Francois KAMMER took part at the meeting.
During the discussion, Serhiy KIVALOV told the guests about the process of judicial and legal reforms in Ukraine, future development of judicial system and activity of the HCJ in forming high-professional judges corpus.
Mr. CAFLISCH informed the colleagues about the activity of the European Court of Human Rights in protecting rights of Ukrainian citizens, who applied to the Court, and also explained the tasks of the High Council of Magistrate of Switzerland.

in the framework of the "Year of Russia in Ukraine", Serhiy KIVALOV, the Head of High Council of Justice, met with the heads of Russian judicial system bodies in Moscow. The following officials took part in the meeting from Russian side: Valeriy Zorkin, the Head of the Constitutional Court; Valeriy Lebedyev, the head of the Supreme Court, and Veniamin Yakovlev, the Head of the Supreme Arbitration Court of Russia.
During the meeting, the issues regarding the process of judicial and legal reforms in both states, future development of judicial bodies, questions related to courts organization and functioning, and professional ethics and responsibility of judges were discussed.
Serhiy Kivalov explained his Russian colleagues about the tasks and activity of the High Council of Justice of Ukraine. He stressed that this constitutional body, created in Ukraine 5 years ago, is now reflecting objectively needs of population related to implementation and strengthening effective democratic mechanisms of justice, forming high-professional judges corpus, increasing its role in human rights protection.
The agreement about conducting a meeting of the heads of the Ukrainian and Russian highest judicial bodies in June 2003, in the framework of the "Year of Russia in Ukraine", was set up. The following issues were planned to discuss during the next meeting: further improvement of judicial systems, implementation of the international standards of human rights into judicial institutions' activity, harmonization of legislation in the sphere of punishment for crimes and judgements execution, collaboration in use of academic achievements in the filed of law and education for training judges.

April 1, 2003,
The 46th session of the High Council of Justice took place and the decision was made about forwarding the submissions to the President of Ukraine on appointment of 41 candidates for the positions of judges in local general, local economic courts and courts of appeal. Alongside 6 candidates were refused the submission with regard on the lack of professional knowledge.
Also the HCJ will forward submission to the Parliament of Ukraine on dismissal of 2 judges on general circumstances: because of retirement and of their own free will.
According to the results of circumstances` examination submitted in the proposals of the members of the HCJ regarding to the dismissal of 2 judges of local courts for oath violation, the HCJ made a decision to close the appropriate proceedings.
During the session, the awarding of 17 judges with the Honourable decorations of HCJ took place for their long-termed and conscientious work and significant contribution to the justice realisation.

The 45th session of the High Council of Justice headed by S.Kivalov, took place and the decision was taken according to which the new members of the Council started their activity. They are: Anatoly Skotar, Mykola Shelest- judges of the Supreme Court of Ukraine; Valentyna Paliy- judge of the Supreme Economic Court of Ukraine. They have been elected as the members of the HCJ by the 5th Congress of judges of Ukraine on October 24,2002.
At the same time the HCJ canceled the membership and power of its members: Olexander Borysenko, Volodymyr Butenko and Viktor Shishkin because of termination of their membership term. They have been elected as the members of the Council by the 3rd Congress of judges of Ukraine on September 20, 1996. The decision was taken by the HCJ after consideration of the corresponding proposition of the Council of judges of Ukraine.
The members of the HCJ, who terminated their power in the Council, made a statement to the press after the meeting. Volodymyr Butenko pointed out that he was agreed with the decision of the HCJ which was taken on legal bases. Olexander Borysenko stressed upon that he was a professional judge and the decision of the Congress of Judges, which was taken according to acting legislation, was compulsory and indisputable for fulfillment.
The Council took decision on forwarding the submissions to the President of Ukraine on appointment of 38 candidates for the positions of judges in local general, local economic courts and courts of appeal. Alongside 11candidates were refused the submission with regard on the lack of professional knowledge.
Also the HCJ will forward submition to the Parliament of Ukraine on dismissal of 3 judges on general circumstances. Particular, judge of the Supreme Court of Ukraine Volodymyr Moisyk and judge of the Supreme Economic Court of Ukraine Volodymyr Karaban expressed their will to terminate judge terms.
Furthermore, the Council took decision on forwarding the submissions to the President of Ukraine to dismiss from office Mykhaylo Borodin (Deputy Chairman of Kharkiv regional Court of appeal) and Valery Fedosenko (Deputy Chairman of Dzerzhinsky district Court, Kharkiv). They will continue to work as judges in the same courts.

On February 27-March 2, 2003
2003 an official visit of the Ukrainian delegation of the High Council of Justice (HCJ) headed by Chairman Serhiy KIVALOV took place to Paris, France. The Ukrainian delegation visited the friendly country on the invitation of the High Council of Magistracy (HCM) of French Republic with the purpose to study an experience of its activity because the functions of the both Councils are identical.
At the beginning of the visit the Ukrainian delegation had a meeting with the members of the High Council of Magistracy. At the meeting the issues of aims, organizational structure, functions of HCM were discussed. The HCM is functioning in France from 1883 but in at present model- from1994. By the way, the High Council of Magistracy is headed by the President of Republic and that enhances prestige of the Council and stresses upon the importance and its activities. Minister of Justice of France is a Vice-Chairman of the HCM and may substitute the President of Republic in his absence. The Council includes 5 judges, 5 prosecutors, representatives from the President, National Assembly, Senate, State Council. Total composition of the Council is 18 members. The majority of the Council members took part in the meeting with the Ukrainian delegation. The French colleges have exchanged their experience of Council functions on selection and education of the candidates to judges` positions, mechanism of judges appointment to and dismissal from the office. The present situation and prospective development of the judicial systems in both countries, organization and functioning of the courts, their independence, professional ethics, responsibility of judges were discussed by both Parties at the meeting.
According to the visit programme the Ukrainian delegation visited the National School of Magistracy, which provides primary and additional training of judges and prosecutors. The National School of Magistracy was established in 1958 and is a state educational institution. The term of training is 31 months and the trainees have theoretical classes and practice in the state administration institutions, courts and other establishments.
At the end of the visit the Parties discussed the trends of cooperation between the Councils, shared their opinions on organization of special probation periods in the National School of Magistracy for senior students of the high law institutions of Ukraine and other issues which are of mutual interest.

There took place the 44th session of the High Council of Justice. On the session the members of the HCJ voted down the proposition of Verkhovna Rada Committee on Regulations, deputies` ethics and organizational procedure to consider suggestion concerning re-election of the Chairman of the HCJ Sergey Kivalov by majority votes (15 against 3).
In its decision the HCJ stresses upon the fact that S.Kivalov `s issue of being the Chairman of the HCJ and a member of the Parliament of Ukraine was already solved by the decision of the Council dated November 29,2002 and within consideration of the previous appeal by a group of Parliament members dated September 26, 2002 and consideration of decision of the Parliament Committee dated November 11, 2002 as well as it is solved by the decision of Kiev Appeal Court dated October 18, 2002 in the framework of these bodies` authorities . The last decision of the HCJ says that disagreement with all accepted decisions does not give any reason for their non-fulfilment and for conscious formation of distorted social position by means of publications with subjective-emotional and political ground.
Besides that, the HCJ perceived appeal of Committee on Regulation, deputies` ethics and organizational procedure as contempt for collegiate body as a whole and for each member of the HCJ personally as well as for constitutionally established procedure of judicial power foundation. This appeal of Committee to the state institutions, which take part in the process of Judge Corps formation , calls to ignore the submissions of the HCJ (forwarded according to the HCJ`s decisions) regarding appointment and dismissal of judges .
In addition to that, the HCJ estimates the propositions and decision of Verkhovna Rada
Committee on Regulation, deputies` ethics and organizational procedure as a tool of pressure upon the constitutional body with the aim to disorganize the HCJ`s activity and to form a negative image of HCJ. Of course, those actions may cause the following results - general decrease of judicial institutions authorities and debilitation of their role in formation of democratic and lawful country. Also the HCJ considers this decision of Committee as an attempt to draw off public attention from real problems of the judicial institutions ,which require the decisions of HCJ in the process of Judges Corp formation .
The HCJ placed demand on Verkhovna Rada Committee on Regulation do not interfere into activities of the independent constitutional body –the HCJ.
At the same time the HCJ addressed to Verkhovna Rada Committee on Law policy , to Speaker of Verkhovna Rada of Ukraine , as well as to the President of Ukraine with explanation of its point of view as a collective body, regarding the issues which were affected by Verkhovna Rada Committee on Regulation. The copies of decisions of the HCJ were sent to Chairman of the Supreme Court of Ukraine, Minister of Justice, High Judge Qualification Commission with the purpose to inform all of them of the point of view of the HCJ.
During the debates on this issue , the members of HCJ were acquainted with results of the scientific and legal expertise in Institute of State and Law named after V.M. Koretsky of the National Academy of Sciences of Ukraine . These documents have the conclusions that the member of Parliament of Ukraine S.V. Kivalov occupies the position of Chairman of the HCJ on public principles legally ( without attaching to this body) . The conclusions say that he may combine legally the MP card with Chairman position of the HCJ .
According to the decision of the Council 49 candidates to the judge positions will be the members of the Judge Corps soon. On this occasion the appropriate submissions will be forwarded to the President of Ukraine for their appointments onto the vacant positions in the local, general, economic and appeal courts. Besides, 10 candidates were rejected of submissions because of lack of professional knowledge for such nomination.
Also the Council took decision on forwarding the submissions to the President of Ukraine and to the Parliament of Ukraine on dismissal of 9 judges on general circumstances , retirement and their own will.
According to the results of circumstances` examination, submitted in the report of Member of HCJ Valery Evdokimov , the HCJ made decision on forwarding the submission to Verkhovna Rada of Ukraine, in regarding dismissal of Kiev Appeal Court judge U.Vasylenko.
Besides, the HCJ complied with the judge request and rejected Judge Qualification Commission decision. The HCJ adopted decision to start proceedings in concerning the dismissal of 2 judges for oath violation .
